Senate Minority Leader Oscar Braynon, D-Miami Gardens, indicated he believed there is still a chance to defeat the legislation.

"I believe one of the reasons that those bills died was not just because that chairman (Diaz de la Portilla) held back the bills," Braynon said. "I think the Senate was probably not willing to hear those bills. The same will probably be true this year."

Our problems with the chair of the Judiciary Committee are over but there is still stealth resistance to OC by some senate Republicans. Known Republican opponents are Latvala and Perry and likely Garcia. In addition, a weakly pro gun Democrat chairs the Criminal Justice committee. The senate President is pro gun but the CJ chair will be very much influenced by Bloomberg bucks and fellow Democrap peer pressure.

House committee assignements have not yet been made.

The argument cites a law that says weapons may not be transported unless unloaded, (or if a bow, unstrung) and encased during transport, "unless the weapon is a handgun." The wording was added in 2011 to allow for people with newly legal concealed carry permits to have their guns with them in their cars.

And that's the point District 1 Judge Patricia Curley made in the case of Brian Grandberry — the exception is clearly meant for people with concealed carry permits, even if the wording of the two related statutes doesn't mesh as well as it should.

This event is a direct response to today's vehicular & blade attack at The Ohio State University in Columbus, where details are still developing. (this post will be updated as more information becomes available)

At the moment it appears that the brave officer who shot the terrorist just happened to be in the right place at the right time - but on an everyday basis other students aren't so fortunate when subject to varying degrees of threat from criminals.

Sure, there's currently a bill in the legislature to give colleges & universities the *option* to allow concealed carry, but so what? When given the option in other states, guess what 99.9% of institutions have decided? No - I don't believe that a student's life is more valuable at XYZ University, nor do I believe that licensed ABC University students are inherently more dangerous ON campus than they OR their licensed counterparts are OFF campus.

As the organizer of six open carry/firearm education Walks on Ohio public university campii (?), I'm sick and tired of the subject of concealed carry on campus not getting the attention it deserves from Ohio's legislators and gun rights groups. There haven't even been hearings on non-optional campus concealed carry!

This needs to end.

Heard a new one yesterday.

Since people at work somehow associate me with firearms at work I get asked about firearms or firearm related laws.
Usually I will try to help but always encourage people to do their own research and if the question really concerns them that they can always retain a lawyer.
Yesterday a coworker came up to me and asked me if I had ever heard of excessive calibers.
Um' what?
He was told by a gun store clerk that some calibers are considered excessive in VA. Example, 9mm or .45 would be ok to shoot an intruder with but that .357 would be considered excessive and the victim may be charged.
I've heard stupid things but this one is pretty far up there.
Sad thing is, this place gives CC classes and I'm really hoping this gentleman is not part of the instruction.

St. Louis alderman Lyda Krewson (D-28th Ward) is pushing a ban that will require law-abiding citizens to get rid of their “assault weapons” over a 60-day period or face fines and jail time..

Educate me, please.

Wouldn't a St. Louis ordinance on this violate Missouri's pre-emption law?

And if it does, why isn't anyone cramming that fact down her freaking throat to show how stupid she is?

Or am I incorrect about Missouri law?

In my state a city/county ordinance violation cannot include jail time and is not a crime. WTF is with these states that allow burgs to jail people for local offenses?

Hi folks

i have been wrapping my head around the most forgotten amendment and less talked about amendment that protects "individual rights' mainly the 9th Amendment.. The ninth amendment will in fact be the protector of the 2nd when and if the anti's rise and attempt to rewrite the constitution..

The 9th, addresses rights, retained by the people, that are not specifically enumerated in the constitution. It is part of the 'Bill of Rights""..

To wit the original 9th amendment..

" The enumeration in the constitution, of certain rights, shall not be construed to deny or disparage others retained by the people"

Twenty one words from the 18th century that need to be analyzed and understood by 21st century Barristers...

The 9th is the law that protects the rights that were so understood in the 18th century that they did not need mentioning however in the 21st century those same rights that were so basic, are now lost, because of public safety, or total disregard for the constitution or in my theory because of FEAR...

More input and thoughts and opinions are needed on the 9th to protect the 2nd...

It's early and reports are widely varying, but as many as eight people were wounded by one or more "active shooters" and/or possibly the attack involved a "machete". recent update states there is one assailant in custody and a search is on for two more "persons of interest".

To make sure we stay topical here I wanted to point out that while open carry is technically legal on OU's campus, (on the grounds not in the buildings) doing so will get a student expelled, and a university employee fired pretty quick. Concealed carry is unlawful for all there except LEO.

Visiting Denver/Aspen this week

Hey guys,

Will be visiting Denver and Aspen for 7 days. I looked around online (specifically handgunlaw.us) and wanted to get some more information on restricted areas for concealed carry (i don't plan on open carrying). Here in florida, we are not permitted to carry in any establishment that is considered a bar (primary source of income is alcohol) or sit at the bar area in restaurants. Does the same apply in CO? Also, what are the restrictions in carrying in establishments that have other marijuana users present (since CO is recreationally legal) - Florida has a law that states if any illegal activities are being committed, it is unlawful to carry in that venue.

The District of Columbia on November 17, 2016, presented Arsenal Attorneys with a check in the amount of $94,121.79, representing payment of attorneys’ fees and costs for the firm's successful challenge to DC’s ban on Tasers and stun guns.

Arsenal Attorneys, on behalf of three District of Columbia residents, last August sued the District of Columbia over its electronic weapons ban. *The Complaint in Wright v. Arsenal then filed a motion for a preliminary injunction seeking an order from the court to lift the ban while the case progressed. *

In September, the District entered into a stipulation agreeing to allow our clients to possess electronic weapons in their homes. *In return we agreed to stay the case for 90 days to allow DC time to repeal the ban on electronic weapons. *

The court in turn issued an order adopting that stipulation. *The stipulation provided for the District to pay our attorneys’ fees.

Currently, pending before the DC City Council is a bill that would repeal the electronic weapons ban. *

We have been informed by knowledgeable Council insiders that the bill is likely to be passed with few, if any restrictions beyond a prohibition on carry of electronic weapons into schools and a prohibition on possession by persons under 18. *It is likely that the repeal of the ban will be accomplished before the end of the year, subject of course to Congress’s review.

There's still no actual bill on the so-called assault weapon ban so there's nothing for me to react to; if/when there actually is a bill and if/when we hear it in the House Judiciary Committee (on which I sit, which has jurisdiction over gun issues) I'll be looking for testimony and evidence that the categories of firearms/magazines targeted by the ban are more lethal than what's left out of the ban. But that will come much later; we are some months away from having any actual concrete piece of legislation to examine, much less a hearing on it.

Washington Attorney General Bob Ferguson has announced the he will ask the legislature to ban commonly owned semi-automatics - a dramatic reenactment of federal legislation which was so ineffectual it was allowed to expire.

I agree with Gun Owners of America that the federal ban on so-called assault weapons had NO IMPACT upon crime whatsoever.

In fact, in the first 10 years after the ban expired, FBI statistics show that the national murder rate dropped 18 percent.

So even though the once-banned guns are now legal again -- Americans are much safer. How do the anti-gunners explain that?

The fact is, they cant.

When you took your oath of office, you swore to uphold the Constitution of the United States -- including the Second Amendment which says the right of the people to keep and bear arms SHALL NOT BE INFRINGED.

I hope that you will OPPOSE Fergusons gun ban and uphold your oath of office. Please let me know what you intend to do.

Disclaimers: The mission of OCDO revolves around handgun open carry. Now that Texas has some form of handgun open carry, albeit licensed for the time being, I think that being good stewards of our opportunity to open carry handguns, and expanding the recognition of our rights to include unlicensed handgun carry, should be our primary effort. Still, this particular case involving rifle carry has some special relevance here in Texas. Also of note that this is not an example of a recommended carry method (in-hand), although we may still defend the right to use the method while strongly recommending other practices.

Of particular interest to me are the parallels between this case, and CJ Grisham's original case. CJ Grisham's case is still awaiting a decision from appeals court, I believe. In this particular case, there are a number of parallels, but I think the evidence against this man was even stronger than the evidence was against CJ, and this man was found not guilty.

I will be so bold as to say, I think this case serves as further indication that CJ's conviction was the result of significant corruption and railroading.

I also wonder if the education efforts of Open Carry Texas and other gun rights groups in Texas contributed to this jury decision.

As we comment on this case, please keep in mind the mission of OCDO and the standard of conduct that is expected on the forum.

New here and hope to have a little bit of help. I've read up as much as I can about this topic just need a bit of guidance. I am a US Citizen and am planning to move to Canada in the next 6 months. I understand I will need a PAL or declare the firearm when moving at the border with RCMP 5589 and then get a PAL within 60 days. Now I am not planning to permanently move to Canada. Maybe just for a few years and then I will intend on returning to the US. From what I gathered from here: http://ift.tt/2geurR7

"If the firearm is registered in the U.S., you do not need a permit to bring it back. If you registered it with CBP prior to leaving the U.S., you can present the certificate of registration or valid proof of ownership such as the bill of sale to CBP."

Now I understand that I need to apply for a US export license, and make an Electronic Export Information (EEI) submission via the Automated Export System (AES) and get an ITN to give the CBP. Now if I do that successfully, will this qualify as registering my firearm with the CBP which will make it much simpler for me to re-import the firearm back into the US (so I can avoid a broker).

Hope someone can help. I'd like to avoid selling my gun and rebuying it each time, and I'd like to avoid a broker (I'm pretty used to working with government legal paper-work....)

Fellow carry friends:

I'm looking for a video that I think was made by a California LEO.

The video starts with him saying "this is legal in California, and this isn't."

He then proceeds to remove the stock and accessories from the one that's illegal, making it legal, and accessorizing the one that was legal making it illegal.

His point was to show that the law isn't about making the firearm illegal, but rather the accessories.

Now that elections are over we know who our elected representative are. Have you met your elected official?

I know the Holidays are coming up but wanted to throw out a suggestion for all the Sportsman's club officers to invite their elected officials for a Q&A session.
This is a good way to get some face time, and push the questions to the front right before the new session starts.

This would also be a good opportunity for the Boy Scout organizations and our younger shooters to interact with the law makers.

Q. Why does it seem like gun owners are the ones who are required to compromise on legislation? (1588, 1491)
Q. Why are we not prosecuting people trying to buy firearms who are not allowed to? (Thousands of gun crimes go unpunished in Washington)

I'm sure there are more relevant questions to be asked. I have often found they (legislators) are simply uninformed; we all have busy lives, our own agendas and families.


The reason I proposed this is simple, none of my legislators will/have been affirmed they have been asked to a gun owners forum.

I say, let's invite them over for a regularly scheduled club meeting right before the new legislative session starts. If they decline then that is ok too, as they can be reminded of this at a later date.

What questions or conversation topics would you discuss at your club meeting if you could get your legislator there?

"ESTERO, Fla. — A passerby shot and killed a person who was fighting with a Lee County Sheriff’s Office deputy on Interstate 75 Monday morning.

While running errands in Sanford today I stopped in Tractor Supply to pick up a fuel hose. So I ask the girl where the fuel hoses are, and she asks "What are you going to use it for?" I reply "fuel". So she looks and we cannot find the hose, so we ask a male employee where the fuel hoses are, and he asks "What are you going to use it for?". Again my reply is "fuel" and "Here's your sign". They must be Hillary voters, I can't imagine anyone else not knowing a fuel hose is used for fuel.

Rudy Giuliani is the favorite to be secretary of state in Donald Trump's administration.

That's according to a senior Trump official who spoke on the condition of anonymity because the source isn't authorized to speak on the record.

The official says there's no real competition for the job and that it's the former New York mayor's if he wants it.

Giuliani said at a Wall Street Journal CEO Council event in Washington that he won't be attorney general in Trump's administration.

That's one of the jobs the former federal prosecutor and top Trump adviser has been seen as a top contender for.

Seen recently many people complaining that :

1) cannot hand out political literature at courthouses
- some even anywhere on the grounds
- some only outside (but on grounds)
- some allow outside and inside but only of they OK the political lit attempting to be handed out (content bias)

2) cannot video record search checkpoints or photograph/vid police activity inside courthouses


3) cannot gain access to public records at courthouses per as the rules and law allow


Anyone have had an issues lately?

Recently I went to hand scan a court docket print-out (I'm sure we have all seen court dockets posted the that day's cases] but was told I'd be arrested for scanning court records [court records may be claimed as an exemption to our open records law but once you post them in a public place you are basically letting everyone view them and declare that the records are not being claimed as being subject to any exemption].

[not talking about inside courtrooms but common areas of courthouse ~ even though videotaping inside courtrooms is OK for media and those who ask and get approved]

Seems like there's a lot of smart aleks, elitists and cop haters in the forums. Quite a turn off tbh. While there's a ton of good, smart people on here, the amount of, well, a-holes is quite frustrating And lately I've been turning to other forums for information and discussions. I mean I see some legit questions on here and discussions only to be ruined by them. Just kind of feel like of you don't have anything nice to say ore I'd doesn't pertain to the question or conversation, don't comment especially if you know it might make someone angry or annoyed. The elitists on here are really bad. Anyone else feel this way?

Open Carry On Your Own Property?

I've seen the post for Open Carry in MA. I live in Massachusetts on the south shore. My neighbor has a pure breed Doberman that seems to think my property is his. For three years I've been in contention with him about his dog rushing at me when I open my door and walk to my car. They are about 100 yards from my house on a dirt road. I've had the animal control officer come and visit him many times, but he just ignores it.

Now... I understand there are laws requiring dog owners to have control over their animal... keep them on a leash or something. But he keeps thumbing his nose at me and the law. I have no idea if he has been fined but I would venture to guess... NO. Or he probably wouldn't keep allowing this.

I have my 84 year old mother with me as well. Since they moved in 3 years ago I've felt like a prisoner in my own home unable to take care of my property or even walk down my road without fear of my neighbors dog attacking me or my mother.

So, I'm going to start carrying my gun with me open carry from now on... maybe even my shot gun. I just want to be sure if I do and my neighbor calls the cops about me brandishing my gun that I won't get in trouble with the law. I need to know the law concerning this... and my right to protect myself and mother when I go out in my own yard form my neighbor Doberman.

So... do anyone know the law on this concerning open carry on my own property?

Open Carry conversations, Pigeon Falls, Whitehall, Osseo

Went down to Whitehall to put a clutch in a John Deere G, and pick up half a hog from Falls Meat Market. Owner of the meat market talked to me about 20 minutes about hunting, the election, how busy he was and how long since he had a day off. No mention of OC 226, which is hard to miss.

Went to Whitehall to put clutch in at Harvest Home Farms, a Christian organization we support. They were having a board meeting and I was invited to lunch. Hog came from here. 3 board members, from Rib Lake, Minnesota and somewhere else in WI. I asked owner if he cared if I carried in his house, he knows, and said no problem. Wi guys were gun people, MN guy never owned one but was not anti. Had a nice lunch and talked some about guns, the election, WI school district administrators, and the election.

Headed home, stopped at Kwik Trip in Osseo for gas. Held the door for a woman going in. She said, "It makes me REALLY happy to see you CONCEALED CARRYING, it makes me feel safe."

I said thanks, but I am OPEN CARRYING, if I was concealed it would be hidden. We talked for about two minutes, I think she felt kind of silly about it, but no big deal was made. Used bathroom, came
Out behind a guy who was walking real slow down the aisle, kind of dawdling with no intent. I'm a fast walker and hate being behind plodders. Got to the end of the aisle and the same woman yells at him, GET OUTTA THE MANS WAY!!! Said have a good day and left.

My wife would have gotten an earful if she talked to me like that in public. Otherwise, a good day except I didn't get anything done at home.

I realize this is an OC forum, but I figured I might get some advice here. I currently OC, have gotten PPPs with no issue, and waiting for a CC permit from another state to go through. I would also prefer to have a NC permit as well. Here's my concern. I am currently under treatment for a "serious" mental illness. The illness is well-controlled with medication, and I am religious about taking it. My career is also such that I care for people in life-or-death situations every day, the point being that I am allowed to be licensed and do this work with my illness.

The concealed-permit form requests all of your mental health treatment records, and physical treatment records for that matter. I have noticed that some counties have "filled-in" forms that list local state hospitals for medical records, etc. Others leave it blank, I suppose so you can fill in your own physicians. I am applying for a permit in a county that leaves the form blank; am I required to provide them the information of my personal physician, therapist, etc.? Or is the fact that I have never been treated for mental illness at a state hospital, have never had LE issues, etc. good enough? If I'm going to have to give them my personal physician's information then forget it, especially when I can legally OC just fine (or CC with an OOS permit). But if they're not going to call up my personal doctor and ask, and I can skip putting down that info at all, I'll go ahead and get it. Any thoughts?

Any tips for non-resident deer hunters?

I know this isn't open carry related but if people will allow my diversion and indulgence here I'd like to pose a few questions as I believe the membership of this forum might be knowledgeable in this area.

I got a call from my brother in law and he said he wanted to hunt deer around here during the holidays. He'll be driving up from North Carolina, doing some business along the way, and stay for the duration of the non-resident deer season or until he fills his tags, whichever comes first. He asked me to look up the rules on non-resident deer hunting for him so he can plan for his trip. I thought I might start a thread here to pick some brains as well as offer advice to others in a similar situation.

First thing is choice of weapons. We will be hunting during the non-resident deer season and so no shotguns or rifles. I have a Ruger .45 Convertible and a Colt M1911, so I'll bring one or both of them. My BIL has a bow, a .44 Magnum, and I think he has a muzzle loader. He did say he'd bring his bow as well as a collection of handguns. I don't know if he'll bring a muzzle loader but he is aware that is an option.

In NC they allow the use of bait but Iowa does not. I've talked with deer hunters before on how they'll play with those rules but we're not going to play those games. My brother has some land as does my mom, both have given permission to hunt but if people have some advice about hunting on public land then I'd appreciate anyone that would share that advice.

How difficult would it be for my BIL to get his license and tags in Iowa? Can he just go to Gander Mountain or whatever, show his NC hunting license, pay his fees, and be good to go? As a non-resident would he have to go someplace special for getting his license? Is there any documentation he should bring to make the purchase of tags go smoothly? Since we are hunting in eastern Iowa we should each be able to get one general (buck or doe) tag, right? We're really looking to get just one deer, if things go well then we'll consider trying for more.

I believe in NC they are not required to wear orange to hunt, Iowa does. I have an orange vest and cap, but BIL might have to pick something up.

I voted at 7:30 am today while openly carrying my 1911. No problems there except for an official attempting to keep me from using a paper ballot. I returned at 9 am with my girlfriend and she was explicitly denied the same method of voting. When I attempted to get the police to enforce the law, the election supervisor pointed at my 1911 and shouted "what's that?". The police chief, Tim, told me I was illegally carrying in a police department. I informed him that was incorrect as the building was not posted and per state law, only the portion of a building that is a police department is prohibited unless legally posted at every entrance. He asked me to leave so I did. A few minutes later, I went home and wrote down WI State 175.60 and hand delivered it to the chief with my cell number should he have any questions regarding the law. I then, without entering the polling place, informed the polling supervisor of this law and advised him to take a legal route to banning firearms.

How can we expect the law to exist if those sworn to uphold them are either ignorant of the laws or corrupt? We must hold them to accountability an force them to do as they swore they would. Men are creature of habit and punishment well not change a man's true character. We can rehabilitate them, and if that fails, ABOLISH, as our founders intended.

Yes, I endorsed Jeff Kemp for Polk County DA in the video but this is my prerogative and of my own free will.

Republicans sweep the Ky. state govenment.

Ky. voters have given control of the Ky. House of Representative to the Republicans for the first time since 1921. Republicans now hold a super majority, holding 64 seats of the 100 member House. Republicans also hold a super majority in the Senate. Combined with Matt Bevin's presence in the Governor's office things look much better for gun owners in Ky. The most probable choice for the new Speaker of the House is Jeff Hoover, of Jamestown. That vote won't be formally taken before January, when the General Assembly starts the 2017 session. Committee memberships and chairmanship will also switch to the Republicans. Its a new day in Frankfort.

We lost some good, gun friendly Democarts last night, too. Linda Belcher of Bullitt Co, Fitz Steele of Hazard and Hubert Collins, who was the sponsor of last year's terrible Constitutional Carry bill are all gone. It's bad to see such gun friendly people leave the House, but they couldn't deliver because of the people that they surrounded themselves with, so they got replaced with new gun friendly people.

Veterans Day is Friday. Our School Administrator has cautioned us to not make mention of God and Christ because the Veterans Day observance is mandatory for his students (~70 K - 12).

I have suggested that we rename the event, Veterans Day Optional for snowflakes observation, or hold at our Lutheran Church (Memorial Day services are held at Bethel Free Baptist adjacent to the cemetery) or wait the prayers, benedictions, anthems and pledges until after the children have departed.

I would ask him if our M-1 Garands, saluting pieces and parade pieces are legal next door to his school building. I will ask our school board to replace him.

Stumbo loses his bid for reelection.

Speaker of the house, Greg Stumbo, has lost the election to another attorney from Prestonsburg. This could be the beginning of the republican takeover of the House of Representatives.

With all the tention and media rhetoric there is at least a better than average (though not necessarily a probability) 0f violence at the polls, so what are you carrying today? Also, did you vote? If not, get a move on! This election is probably the most important in modern history.

I know some states prohibit carrying At the polls but Michigan not only allows it but if it is a pistol free zone it REQUIRES Open Carry.
