A Circuit Court judge in Virginia has ruled that fingerprints are not protected by the Fifth Amendment, a decision that has clear privacy implications for fingerprint-protected devices ...



According to Judge Steven C. Fucci, while a criminal defendant can't be compelled to hand over a passcode to police officers for the purpose of unlocking a cellular device, law enforcement officials can compel a defendant to give up a fingerprint.



The Fifth Amendment states that "no person shall be compelled in any criminal case to be a witness against himself," which protects memorized information like passwords and passcodes, but it does not extend to fingerprints in the eyes of the law

The question of whether a phone's pass code is constitutionally protected surfaced in the case of David Baust, an Emergency Medical Services captain charged in February with trying to strangle his girlfriend.



Prosecutors had said video equipment in Baust's bedroom may have recorded the couple's fight and, if so, the video could be on his cellphone. They wanted a judge to force Baust to unlock his phone, but Baust's attorney, James Broccoletti, argued pass codes are protected by the Fifth Amendment, which prohibits forced self-incrimination.

2. According to Armed Campuses, colleges in Arkansas, Colorado, Idaho, Kansas, Mississippi, Oregon, Utah and Wisconsin allow the carrying of firearms on their premises, including concealed weapons in three of those states. Lawmakers in 14 other states have introduced bills this year that would allow permit concealed carry on campuses.



3. The U.S. has more guns and gun deaths than any other developed country in the world, with 88 guns per 100 people and 10 gun-related deaths per 100,000 people, more than any of the 27 other developed countries, according to a 2013 study by two New York cardiologists.

Shooting reloads in my Beretta 92 FS

I took my new Beretta 92 FS out yesterday and shot it for the first time. What a sweet shootin' gun. However, I had an experience that I need advice on. While shooting reloads, the slide would not lock in the open position after the last shot. The slide would be closed, and the trigger would fall on an empty chamber. Is this because of the reloads? It didn't seem to do this while shooting the factory loads, and it only did this on some of the reloads. It even happened when my buddy shot the reloads in his Sig. Any thoughts or help would be greatly appreciated.

What can be done to protect public safety? When police and the military can’t be everywhere, the last line of defense is having more citizens carry guns.



Simply by using the Internet, ISIS has encouraged “lone wolf” individuals. These “wolves” have initiated attacks on their own with no planning or coordination with others and without leaving a trail of clues about their intentions. Law enforcement authorities and our government are not well suited to defend against such individual terror strikes. As Israel has learned about such attacks, there are just too many targets to defend.

He gives a rather comprehensive checklist of behaviors and "indicators" of things that add up to/add strength to an officer's determination that Probable Cause exists. Some of the items he discusses have been found to be unsupportable in some jurisdictions, but his "scorecard" system helps an officer build up his case for PC in spite of one or two items not being countable. And no, there is not a baseline score that has to be reached in order to say PC has been "reached". It's more of a reminder of stuff to add to the dogpile in case one element does not stand up to challenge.

Got "Probable Cause"? One District Attorney's attempt to explain why "Yes"/"No"

Concealed carry, concealing a problem.

Before the m&p shield, and the XDs. for conceal carry especially in the summer, we basically had .380's. While they are better than nothing, we know that the trade off between ballistics and portability is bad enough, however the trade off between ballistics and concealability, (new word) is even harder. In 2009 I purchased a Walther PPS, in .40. It is less than a inch wide, .900 and tucks anywhere, while still delivering 6-7 rounds of "decent" self defense. It was one of the frontrunners to the new rage of larger caliber sub-compacts.



5 years later, I have taken it for granted. It has been a robust, go to gun in the event I could not open carry. While not as fun to shoot as a full size gun, I still take it out and put it through the paces, on occasion. I hope you never experience the horror I did as I was out in the desert doing my regular drills, I Come out of the holster into a 1"square as quickly as I can Guarantee it. As I transitioned to my conceal carry rig, My first presentation from concealment went smooth, then I heard a loud "CLICK." My training appeared, Smack, Rack/Flip, decide to shoot..... "CLICK. Another instant replay, resulted in a "BANG" I put the "dud's in my pocket to inspect later, and continued to practice. The gun ran problem free, but my mind was running as well, What if my life had depended on that first shot?



To say that I was troubled, would be an understatement. As the scenarios of how wrong that could have been, I Started the process of searching for a new, reliable carry piece. But curiosity got the best of me. I had never messed with that gun other than field strip and clean, keeping with the mantra that stock was best, "If it aint broke, don't mess with it." Since it was broke, I decided to knock the pins out and give her a look.



What I found was crazy, I should have taken pictures. While the outside of the gun was in good shape minus some bare spots where the bluing was worn off, the inside sub-frame assembly and inside the slide looked like they had been filled with a redish, orangeish silicon. The steel parts of the sub-frame were coated with a crystallized rust appearing substance. I was mortified that I had no idea. The guns that I train with, I go through all the time, piece by piece. so I had never witnessed such neglect, and it was all on me.



In the end it cleaned up fine. I spent some time on everything, while the polymer frame took a spin through the dishwasher. It is back up and running, and I am not looking for a replacement ...yet. The silicon substance appeared to consist of a mixture of: cleaners and lubricants that had absorbed into lint, and dead skin, that was also subject to salty sweat. Now you know why I did not take pics. Trust me it was gnarly.



I shared this, as I learned a lesson. "If it aint broke, don't mess with it is not accurate." If your life depends on it, learn it, know it, and understand it, while maintaining it.... That "CLICK" sucks!

Funny thing is I am good at the stuff, and do it all the time. Just did not maintain the one that needed it most. (Poor form on my part.)

Open carry in car without permit legal... statute cite?

I live in NC but work in TN. I have read that as of July 2014 it's legal to open carry in TN in my car, but I can't find any statute or code stating this. Can someone point me to the law stating such? This week I have seen random checkpoints across the border in TN on my commute from NC-TN and I want to be able to inform any LEO who doesn't know the law about my right to open carry in the car in TN if need be.

1. The Declaration of Rights in our constitution is unique in that it does not delegate authority to our legislature to regulate bearing arms for defense. Two different ordinances were introduced during the Constitutional Convention of 1901 that would have delegated that authority, but both were rejected:

I'm mew to this forum and also new to wanting to open carry a weapon. I live in Jax Florida and was wondering big I can openly carry a 3 foot decorative sword o. My back? I am going out dressed as Michonne from the Walking Dead and Michonne isn't Michonne without a blade. Can anyone here to clarify some laws that may prohibit me from doing this? Booted out of Lesiglative Office Bldg in Hartford - 4 passing out lit

A boring day at the Capitol Complex today .. until I got there of course.



First, trying to get into the parking garage a little altercation with the soldiers of the armory who think that they can block traffic for 15 minutes....



Anywho, I get into the legislative office building [aka LOB] over near room 1800.



Now there is a checkpoint for us lowly citizens but I just go inside and do not proceed to the checkpoint; I'm there to provide literature to other citizens informing them that the checkpoints violate the 4th amendment and our open meetings law.



A slow day ... maybe 1 person going in every 3 minutes ... but I hand out literature to about 5 people when the Capitol Police come and tell me I cannot hand out lit there.



So I ask if I can do so beyond the checkpoint ... nope.



No literature can be handed out inside the Capitol Complex...so said Sgt. Barter. So I go outside for a while...handed out lit for 1/2 hour (even to some kids on a school field trip).



I'm also at the LOB to chk on a record request ... so into the bldg I go. After chking on my record request I go to the senate & house offices and file complaints about both the checkpoints and also the new issue of 1st amendment violation of not allowing literature being handed out at the LOB.



From there I go to the Office of Legislative Management [OLM] ... I have a short visit with James Tracy about the 1st amendment issue [he's well aware of my objection to the checkpoints ~~ and according to records obtained, he wanted to really mess w/visitors to the LOB during the gun task force time period]. Yet he could not ID any authority (and he did not even know they the police were acting as they did) to disallow the distribution of political pamphlets to people inside the LOB. So he is going to check into this and get back to me.



I see another Capitol Policeman, Ofr. Lombardi, who says that political lit can be distributed inside the LOB if permission is gotten from James Tracy. So a different answer than Sgt. Barter...now Mr. Lombardi notes its in the legislative guide....(I looked and could not find any reference to allow for the violation of my fist amendment rights).



So, off to the Gov's office...meeting with Trooper Nickelson (sp?). He saw an issue with the capitol police and the 1st amendment in respect to handing out lit ....



So I ask the trooper if his dept. would protect me from the Capitol Police...he laughed a little and said that he would look into the issue and get back to me.



From there, out of the LOB to review records at another agency in Hartford...and the end of my day in Hartford...



So lots of people involved now with the first amendment issue of handing out political lit inside the LOB.



Now I routinely swap lit with people, usually in committee meetings or outside meeting rooms w/o incident.



I could always just talk to people about the illegal checkpoints too ~ last time I did that, a Capitol policeman cam over and told me I could not do that ~ I suggested he arrest me or leave me alone (and he left me alone).



All these thugs just follow orders w/o concern for anyone's rights .... I told a few that that was a Nuremberg defense....

I probably won't be able to make it...but I'm trying to get a 500 round can of 165 grain .40 S&W. Precision One worked out great last time and the price wasn't horrible at $180. I've heard good things about Georgia Arms too. Either way, if someone would like to help a brother out, I've gots da moneys! 1000 round cans are cool too, but the price would have to be right.



Always on the lookout for full power .460 Rowland practice ammo as well...although that's probably a longshot.

In July, 2006, doctors in Phoenix, Arizona diagnosed Robert Daniels with extreme multi-drug-resistant tuberculosis (XDR-TB)1. After visiting a local convenience store without a mask, public health officials obtained a court order to involuntarily commit Daniels to a Maricopa County Medical Center lockdown ward for treatment and to prevent him from transmitting his illness to others. Hermetically isolated, he was strip-searched and prohibited from venturing outside, exercising, and receiving visits from family.2 On May 31, 2007, the American Civil Liberties Union (ACLU) filed a lawsuit against Maricopa County, Arizona, on behalf of Daniels for the deplorable way he was treated - [l]ike jailed inmates accused of crimes3." While states have the authority to quarantine and isolate individuals with dangerous and communicable diseases in order to protect the public's health, they also have a duty to respect individual civil liberties4. This article discusses states' roles in protecting individuals' civil liberties while simultaneously effectuating quarantine and isolation orders to protect the public's health.

Progress is being made around Texas in regards to understanding and acceptance of open carry. Here's an example of a very matter-of-fact article published in a local paper about (then) upcoming OCT participation in a county fair parade. Of course the fair went off without a hitch and OCT's participation was no different. This has become par for the course and it's encouraging to see more people become aware of and accepting of open carry and their rights to equip for general defense.

Derek Jeter recently hit his last home run. The baseball bat he used will become a piece of famous sports history. People will travel from everywhere to see it and take pictures of their children standing next to it. Now, how about that same sporting equipment used in Joe Pesci’s last scene in Casino? Or by Robert DeNiro in The Untouchables?



(go ahead - Google "Joe Pesci Beatdown - Casino" even for me it is a bit too gruesome to post here.)



Doesn’t quite have the same feel, does it? Baseball bats are used quite often to bludgeon a victim to death, but we would look foolish if we called them “weapons” when we passed the rack at Sports Authority. Why? Because more bats are swung at baseballs than people, despite their origin as one of mankind’s first weapons, the club.





Similarly, the first use of a self-powered vehicle was to move artillery. In light of the tens of thousands of deaths by automobile, are they weapons or vehicles?



Firearms were originally designed as a battle implement. Their first purpose was to inflict human casualties; there is no argument to that fact. Today that is simply not the case - the vast majority of ammunition is produced and fired peacefully at paper targets. It is almost always incorrect to call pistols, rifles, and shotgun “weapons.”



So, why do some people insist on calling all firearms “weapons” in any situation? The answer is simple: Brainwashing.



Fear sells newspapers and keeps attention. This comes from our primal need to survive. On the 6 o’clock news, we all keep track of the Ebola virus. We want to know if it’s close to us. Some might tune out for sports and weather, but we will all have a universal interest in staying alive. Media knows that, so they provoke that emotional reaction the most natural and effective way possible–by implementing fear.

Please remove this post if it's in the wrong category. My name is Mike and I'm a Ohio National Guardsman. I'm also 19. In the past few weeks I've been in contact with my local senator and I'm still waiting to hear from my representative.

The subject I've been discussing with them is the right for military service members under the age of 21 to CCW. My local senator agreed with my key points, those being that if I'm entrusted to fight in various countries with weapons of war, why cant I defend myself here in the states. He urged me to start a petition so any bill introduced could have some power behind it.

It doesn't matter if you're an Ohio citizen or not, if you agree, please sign and share my petition. Thank you.

NFA challenge

Due to a recent blunder by the ATF in regard to NFA Trusts they opened the door for people to apply for automatic weapons tax stamps under a trust as a trust "was not a person". Not being a person a trust would therefore be able to own a fully automatic weapon. The ATF under Obama was trying to prevent people from getting suppressors with trusts without having the cockblock of the chief LEO signature.



So a lawyer is now taking a case representing those people to challenge the 1986 ban and the 1934 NFA. With some other rulings now decided (Heller, McDonald) this may have some more momentum.

I'm not a big follower of politics but its my understanding that Dave Brat is pro-gun, endorsed by the NRA and Gun Owners of America. Can't say I've heard anything from the VCDL about him.



Not sure about how his opponent Jack Trammel view guns.



I'm sure there will be things that you agree with and disagree with about both guys.

Concealed Carrying and its limits

Hello All,



I am hoping to get some clarification...



Here's the scenario: I enjoy drinking at my house on the weekends but I also have a small dog that needs to go outside to the bathroom frequently. In northern VA having your own yard is pretty rare so anytime she needs to go out, I am going to be in the common area of our complex. If I had my own private yard I wouldn't feel the need to carry but since I am going through some sketchy wooded areas to let her relieve herself, I am much more comfortable concealed carrying. Is it legal for me to concealed carry if I am under the influence? Right now I leave my firearm at home because I am not going to risk it, but I would like to know if I have the option. Just so everyone knows: if I plan on drinking I never carry my gun, the question is, if I am drinking is it illegal to carry? I don't care about going out to bars and carrying... I am more concerned that if I have had some drinks at my house and I need to take my dog out, can I carry?



Appreciate any information you may have.

9x25 Dillon

Well guys, I'm already thinking ahead to my next pistol, and naturally I am reverting back to my 10mm dreams since they were put on hold to complete my .460 Rowland conversion.



For those who don't know about 9x25, it is a wildcat round made from a 10mm case necked down to take a 9mm bullet. Since I am going to be buying a 10mm anyway, if you haven't already figured out my love for white-hot loaded high energy/high velocity somewhat obscure rounds, going with a 9x25 Dillon conversion is a no-brainer for cool factor. It's arguable whether or not it has an advantage over 10mm. I personally don't know, but it sounds like a very interesting round. Interesting enough to warrant spending an extra $125 for an option at least. I'm still debating between going 9x25 or just getting an extended, ported 10mm barrel.



This round has been described as a .357 Sig on steroids. Ranging from 90 grain to 125 grain bullets, velocities range from 1,400 FPS-2,000 FPS (feet per second), with an average of about 800FPE (foot-pounds of energy). 125gr 9x25 will get you about 1,700 FPS/800 FPE. Hot 150 grain 10mm loads will achieve about 1,500 FPS/775 FPE, so not very much difference except bullet size and weight. Where the 9x25 excels is with a light bullet out of a 6" barrel - 95 grain controlled expansion JHP comes in at 1995 FPS/881 FPE out of a 6" Lone Wolf barrel. Wowzers!





Anyone have any experience with this cartridge?

By Golly, the Barney Fife Solution - I think it could work!

I was sitting here talking about the rampage in Stockton where a gang of thugs killed a hostage and shot up the city, when I blurted out:



"We've been talking about disarming the police, eliminating the asset forfeiture without conviction law (license to steal), and removing the military vehicle upgrading that's been occurring, they really ought to just issue all LEOs two bullets"



Suddenly, it occurred to me that this might, indeed, be a viable solution. If every cop is given a firearm which can only shoot two bullets (or three, whatever), then they'd be A LOT less likely to go Rambo on us. Still possessing enough deadly force to deal with, oh, what is it, 95% of armed confrontations being solved with 2-5 rounds, and allow self-protection, but not nearly enough to use the 'spray and pray' method of crime interdiction, it might start a trend of arms de-escalation.



Now, of course cops could carry back up, they could carry extra bullets, they could get a shotgun out of the trunk, heck they could carry handgrenades. But the idea of having only 2-3 bullets is a reasonable and workable alternative to disarming them which both sides might be able to accept.



Of course it will take a tragedy of epic proportions where cops kill innocent children by shooting them in the head or throwing a grenade into a baby's crib...oh wait, they've already done that... :uhoh:

Obama's Solicitor General says 'Get rid of your guns if merely accused of a crime'

The US Supreme Court just granted certiorari to a case in which President Obama's Solicitor General told the Supreme Court that "there was no need for the Supreme Court to hear the case, in part because Henderson could have sold the guns prior to his conviction," thus explicitly meaning that if you are accused of any major crime, you better sell your guns quick, or lose all chance at retaining your financial interest in the guns if you are convicted, even if your appeal is still pending.



Equally troubling was Obama's Solicitor General's statement that a person convicted of a major crime could not transfer his firearms to "his wife or a friend" because it would create "a significant risk" that he would still retain access to them. After all, a man's conviction does not cast a scarlet letter against gun ownership by his wife and friends. Missouri law permits the open carry of a firearm with few exceptions. Citizens may

openly carry firearms in public places unless there is a specific prohibition against

carrying a firearm in that place (police station, school safety zone, hospital, courthouse, etc.).

Since the passage of Missouri Senate Bill 656 possession, purchase, other acquisition, transport, storage, carrying, sale, or other transfer of firearms, their components, and their ammunition is only done by state and federal law.



Local municipal laws may only regulate the discharge of firearms.



Therefore, officers should not charge individuals with violations of the any

In such situations, an officer must observe the subject and

evaluate the totality of circumstances to determine whether reasonable suspicion

exists to justify detaining the individual. If the individual is doing nothing else that

arouses suspicion, simply wearing a gun will not justify a detention.



It is important to note, open carry by itself also would not support a charge of

Disorderly Conduct or Inducing Panic. There must be additional facts to support

these offenses. If someone is lawfully carrying a firearm—and doing nothing else—

the fact that it causes alarm to others does not support a charge.



Private businesses or property owners may prohibit all firearms on their property.

They may post signs prohibiting firearms or they may order a person to leave for

such behavior. Criminal Trespass is the appropriate charge if a person is on private

property in violation of such a prohibition.

My GF and I moved to Alexandria (near Mount Vernon) from MD last June. Since the move we have both been interested in flexing our previously suppressed 2A rights. We, of course, want to be safe and smart about it so have progressed slowly which eventually led me to this site. She was not interested in OC at first but she recently has fallen in love with our new custom G34 and it may soon replace me in her heart. She may end up registering here before long.



We would love to learn from those here that would be willing to teach/advise. I may try to attend any events that occur anywhere near Alexandria. Additionally if anyone near us would like to meet up for some intro OC on the weekend I would be game.



I did do my first OC last Friday at the Magic Skillet on Richmond Hwy. It was wonderfully uneventful.
