I doubt that they will get their $700K back and I don't care if they did ... They apparently go by the European rules regarding such things.

Those 4 folks likely will be on the hook for that $700K. In theory. Reality? Can be different.

Generally when a judge tells ya to drop a case and their is liability if not done, then hey, you really like rolling that loaded dice !

I won't live in a state that follows the european rule ... for good reason.

I have been told several times by judges to settle...sometimes I do, sometimes I don't.

In the real world, not fantasy legal theory world, IMO its harder for a plaintiff to get a win than it is for a prosecutor to obtain a guilty verdict. Our system's broke yo.

I know there has been some issues in VA about non resident permits lately. Has that issue been resolved? Is my Pa permit valid or not in VA? Can I carry in my car with out a permit? I know OC is legal in VA but can I OC in my car?

State lawmakers in California recently offered a unique solution that could appease both sides: the gun violence restraining order. The statewide policy, which went into effect Jan. 1, 2016, is based on the domestic violence restraining-order system, in which concerned citizens can turn to the courts for help, said Frattaroli, who serves as associate director for outreach for Johns Hopkins University’s Center for Injury Research and Policy.

Specifically, the gun violence restraining order addresses concerns a loved one or neighbor might have about someone experiencing any crisis—whether an age-related ailment like dementia or something else like job loss or a spouse’s death—that might prompt them to harm themselves or others with a gun, Frattaroli said.

A judge can order police to remove the guns for up to a year, as well as prohibit the troubled citizen from buying new guns, she added. An assemblywoman introduced the measure in 2014, two days after Elliot Rodger, 22, fatally stabbed, shot or hit with his car 20 people (six of whom died) before killing himself in Isla Vista, Calif.

I just finished my Monday heavy-housecleaning chores, that today included scrubbing a 100 sq. ft. patch of carpet between the door to the garage, the front entry door, and the door from the Garden Room atrium into the great room.

I had procrastinated too long I thought as after an hour of scrubbing with a gallon of solution I could still see variations of color and brightness. Well heck, I thought, maybe I'll have to pay for a service call (Island, remember, 100 mile round trip). So I spent another hour rinsing and drying until my carpet cleaner's moisture detector showed none. I brought out a utility fan and arranged it to sweep the carpet and put away my cleaning materials.

Then I turned off the little chandelier and all of its little shadows and bright spots disappeared. I am very pleased.

So, the vid has a couple details the article left out. The intruder pepper sprayed mom and the youngest boy, and thats when the oldest grabbed a sword and charged. Too bad he didn't get the guy.

Police showed up "in minutes" and were unable to find the suspect even with a K-9. Mom went out the next day and bought a gun. If I were her, I'd also be reinforcing that door frame. The vid shows it to be very badly built.

i went visiting yesterday, me, my wife and son went to my mother inlaw's. i found out that my sister inlaw and her husband just bought new handguns and plan on getting a permit soon. untill then they are gonna carry in their truck, so they decided to ask a officer where and how to carry. i wished she had got his name but didn't, i plan on calling tomorrow and asking too and having the info i need in case of a disagreement, as today is taken up with church and a family outing. now this is what the officer said, he first said and this was right that she can put the gun in any compartment installed by a manufacture that has a lid, but the second thing he said i believe is wrong. he said she could keep the magazine loaded but could not keep one in the chamber, i pretty sure that is wrong, if not let me know and save me a call. but i remember reading somewhere that a person without a permit can have a loaded gun in any compartment installed by a manufacture. this was in glasgow, so i will call tomorrow and let ya'll know what i find out.

I recently commented to my tiny forwarding group of two or three on the recent reports of the desecration of veterans' graves, by the removal of Confederate Flags in one case, and theft of medallions for sale as scrap in the other. One gentleman, veteran of significant in-country Viet Nam air adventures, responded, "when will it end, and it will end."

I prepared to cite T. S. Elliot's The Hollow Men back at him, but was distracted by Hag Hillary's mention of "alt-right" that I had not heard of, or attended to mention. Investigating the Alternative Right, I noticed one site illustrated with a classic painting of The Charge of The Light Brigade, eponymous of Tennyson's Poem.

What a delightful contrast, 'The Six Hundred' were not The Hollow Men, but in the end no difference was accomplished.

Even more wonderfully, the whimper is Guido 'Guy' Fawkes' as he mounts the gallows. Guido, the icon of the anonymous progs. I'll have to share this tidbit of exegesis with my literature professor neighbor.

W.D. Texas Judge rejects claim that allowing guns on campus violates the Constitution

Apparently legally armed citizen charged with homicide at MPD 6th Dist. Station.

According to the criminal complaint:

Drescher's friend, Copper Castillo, had planned to buy a Benelli shotgun outside the police station Thursday.

Drescher told his friend he would accompany Castillo to the sale because of the danger of a robbery at such a transaction.

Castillo and Drescher were parked in a van outside of the station when they were approached by Carlsen, who asked them if they were looking at him and if they were cops.

Drescher told Carlsen to go away, and Carlsen threw a traffic cone through the window of the van.

As Carlsen began walking away, Drescher got out of the van to put the cone back and Carlsen started walking back toward him.

Drescher pulled out the handgun he was carrying and pointed it at Carlsen as Carlsen approached. As Carlsen got closer, into what Drescher called his "danger zone," Drescher fired the gun until he felt Carlsen no longer posed a threat.

I hope I'm not doing something wrong but I recently posted in the Whatcom County OC thread about the Port of Bellingham Public Use Policies and Procedures which disallow firearms on public property managed by them. I thought that maybe the other thread was not the correct place to discuss the issue so I am starting a new thread here.

Someone also asked, in that thread:

"Is the Port of Bellingham a "Cities, towns, counties, and other municipalities" as required by the state law or is it a state or federal agency?"

I still don't know the answer to that question but I did find this:

"The Port of Bellingham is a countywide independent special purpose government located in Whatcom County overseen by three nonpartisan elected commissioners. It was created by a countywide vote in 1920. The post about the Danville swimming pool, got me interested in some city ordinances that I had put away for a while. I found these back in 2012, when KC3 was deciding what violations where serious enough for lawsuits. I had put aside some that were not very serious and we concentrated on the worst. I had forgotten about these and started through them this weekend. On Sunday, I found one from the City of Morehead. Actually it was a little more serious that I had remembered. This was the last one discussed and just barely missed the cut for a lawsuit. I remember saying that the mayor of Morehead had been very polite and cooperative in our discussions about the "No Guns" signs at the Morehead Convention Center and I suggested we cut them some slack. Then I failed to follow up. Here is Morehead city ordinance 22:2006:

§ 35.031 WEAPONS IN THE WORKPLACE.

(A) Employees are prohibited from carrying, possessing or storing a deadly weapon while on-duty, or upon city property, including vehicles and equipment owned or controlled by the city while on-duty or off-duty except as listed below:
(1) Sworn police officers of the city.
(2) Animal Control officers of the city or an employee acting officially in the capacity of the Animal Control officer as approved by the Mayor.
(B) Deadly weapon shall mean:
(1) Any weapon from which a shot, readily capable of producing death or other serious physical injury, may be discharged.
(2) Any knife, except an ordinary pocketknife or other knife routinely used in the performance of city duties.
(3) Billy, nightstick or club.
(4) Blackjack or slapjack.
(5) Nunchaku karate sticks.
(6) Shuriken or death star.
(C) Artificial knuckles made from metal, plastic or other similar hard material.

Sunday night, I sent the mayor of Morehead an email about it. This morning, I received a response that it had been sent to the city attorney for review. This afternoon, I was CC'ed on an email response from the city attorney back to the mayor saying that I was correct and the city needs to fix this. They claim to be in the midst of a complete rewrite of their personnel handbook and will fix it there, also. Later the mayor sent me another message saying that he would keep me advised on the progress on this. He said that they hope to have an amended ordinance for introduction at the September meeting of the City Council. This is pretty quick action for a government. Sometimes they can drag their feet for weeks, before doing anything. Everything was very polite and friendly, just the way it should be. I have sent the mayor a message and asked how they intend to fix it. They could repeal the whole thing or just remove the reference to firearms. In the past, I've experienced a little resistance from some cities about guns and employees. It seems that many of them never comtemplated that 65.870 applied to employees and it took a little time, and a little reading, for that to sink in. After rereading the statute a few times and not being able to find any exception for "personnel" policies, they usually start to come around.

The New Britain court, in case # HHB-CV16-5017349 (memo ^^^) noted (pg 8, 1st paragraph)
that a person who files multiple complaints at the freedom of information commission may not have his cases heard there, solely because of filing multiple cases and regardless of the merits of the various cases.

So, it appears now as if filing a case at the FOIC is not mandatory and for those that file multiple cases, a futile and useless thing to do.

So where would a person file a complaint relating to a violation of the Act now? Well, one could still file at the FIC and if bounced out, then file at the claims commission (if a state agency ~ you cannot sue a state agency directly) or at your local superior court. But the law cannot make you do a useless thing so the need to exhaust admin remedies is no longer required.



If you have cases pending at the commission for records, I would say ask for the records again and if denied, file a claim either in superior court or at the claims commission. If its a meeting violation and one issue is lack of minutes...then everyday no meetings are produced is seen as a new cause of action and a complaint can be filed w/o the need for anything else (again either at claims commission or superior court).


And since the court noted these limits the FOI commission would have no choice but not to hear cases regardless of their merits. CGS Sec. 1-206 notes this.

Imagine my shock today when I was informed by an employee that Southern Police Equipment (aka Southern Gun World) on Midlothian across from VSP headquarters no longer allows other than LEOs to carry armed there.

They have a sign on the door now to that effect. Will post it shortly.

Forget that we are safer than the average LEO, commit less crime, and that neither the store nor a LEO is responsible for my safety.

Have always subscribed to the tenet that it is how a person acts, not what he/she is wearing/carrying that counts. Apparently, a properly holstered guns on the hips of freedom loving people scares them.

There are other gun stores in Greater Richmond - they will get my business.

Guessing that it's getting late in the game to think about what fixes should be considered in next year's session, I fired this off to my 2 reps plus another. Please feel free to chime in or echo with your reps if you agree:

§ 18.2-309. Furnishing certain weapons to minors; penalty.
A. If any person sells, barters, gives or furnishes, or causes to be sold, bartered, given or furnished, to any minor a dirk, switchblade knife or bowie knife, having good cause to believe him to be a minor, such person shall be guilty of a Class 1 misdemeanor.
B. If any person sells, barters, gives or furnishes, or causes to be sold, bartered, given or furnished, to any minor a handgun, having good cause to believe him to be a minor, such person shall be guilty of a Class 6 felony. This subsection shall not apply to any transfer made between family members or for the purpose of engaging in a sporting event or activity.

I'd like to ask you to please work to amend the section above, so that the bladed tools in subsection A also have the same exemptions as handguns do in B, to allow transfers between family members or for the purpose of engaging in a sporting event or activity.

If I deem my daughter to be trustworthy with a kitchen knife to defend herself at home when alone, but not a firearm, then why can't I choose to trust her with a safer, more effective bowie or dirk?
If my daughter fancies a dirk or bowie knife at a convention show, why can't I make that choice to get one for her, even if it's just a keepsake?
If I'm carrying a bowie knife or dirk while fishing or camping, why can't I let her use it for a given task?

Within the last week, I have had several guns aimed in my directing while in stores and at a range. What the heck is up with people who forget this? Even today at Green Top in Richmond, had a guy sighting a rifle at me. He seemed to take offense to me asking him to not aim the gun at me with a "but it's not loaded" sort of reply. At a range the other day, a guy with a rental that jammed, comes out with it, swinging it around LOADED, to complain it was jammed. Thankfully, the guy behind the counter grabbed it ASAP and gave him a little speech on the matter.

From a young age, I was always taught to treat every gun as loaded, even if I just unloaded it. Maybe I have been through too much gun safety training and am being a bit paranoid, but I can't think of anyone who would not have a problem having a gun aimed at them.

On Thursday, U.S. District Judge Sean F. Cox of Detroit ruled that a local funeral home was well within its rights to fire a transgender employee because its owner had a religious belief that gender transition violated biblical teachings.

I am due soon to renew my CCDW permit. This will be my first time doing so. I received my notice today and I would like any help you guys can give me. The section of my renewal notice that I have highlighted in yellow. Am I responsible for having a Notary Public take care of this or is this something the Sheriff's Office can help me with? I don't mean to sound dumb. This is just my first time to renew my CCDW.

Some of you may remember Christy Contrell who was the dining room manager at Golden Corral on Providence Rd up until several years ago when she left to become the manager of Carrabbus Italian Grill on Midlothian. I thought the deal she said was offered was too good to be true - turns out I was right.

She is now the dining room manager at the newest Golden Corral in Hopewell. She has invited us to have an OC breakfast there soon. Told me that she sees a lot of OCers there and of course they are close to Ft. Lee.

It's not that much of a drive for central Virginian's - it's as close time wise as Rise & Shine Diner. I see this as being part of the Greater Richmond Metropolitan Area.

She won't be working this Sat. morning, so it will have to be another weekend........soon.

DeVos Place doubles down on it's illegal ban of firearms.

So, back in March, MGO and MOC reps at a Womens Expo were told to remove their open carried firearms from DeVos Place.

In conjunction with their response to the MOC/MGO lawsuit, SMG has said they will put up signs spelling out the ban on weapons at DeVos Place convention center and DeVos Performance Hall. SMG is a management company hired by the Grand Rapids-Kent County Convention/Arena Authority, formed by Grand Rapids and Kent County by public act. The buildings themselves are owned by the Grand Rapids City-County Building Authority.

Here is the MI statute that lists prohibited places, AND the ever so helpful EXCEPTIONS, specifically subsection 2, line C: A person licensed by this state or another state to carry a concealed weapon.

Now, being that DeVos and Van Andel Arena are both owned by a governmental authority, it's pretty clear that MI statute 123.1102 (aka: Preemption) comes into play. It seems clear cut, but as we saw in the Deffert case, the judges around here can be morons.

Florida, Georgia, Tennessee, Indiana, Ohio, Kentucky, Nebraska, Missouri, Kansas, Iowa, the Dakotas, Wyoming, Montana.

We did have to "disarm" running through the southern part of Illinois for a short time, but the rest was just perfect.

Talked with a few LEO's in Nebraska and South Dakota. No problems, of course.

All restaurants, motels, camp sites, fast food places, various stores, gas stations, plazas and generally everywhere you go in a normal day. Not a single problem.

As open carry has been my choice for daily carry for over 6 years now, I always find it refreshing not to need an "excuse" to open carry, as we do in Florida. Luckily the excuse needed is always in play for me, so from the moment I left the house until I returned a week or so later, it was a good open carry vacation!

We'll be travelling to Tennessee for a short vacation in October. Two couples, my best friend and I are looking to carry. I have my CCDW conceal carry license, my best friend does not have his yet.

I've done a little reading and I notice Tenn. requires permits to carry for those living in the state but I'm writing to ask what the laws are for those vacationing there? I usually carry in a semi-concealed carry IWB holster. My friend usually carries in an OWB Serpa style holster.

Looking for knowledgeable gun law individuals to help us stay within to law. From my understanding, I shouldn't have any issues in carrying but my best friend who doesn't have his concealed carry license might.

Also, what is the state laws for restaurants if they derive more than 51% of their sales from food? Anything further that we should be aware of?

Chesterfield County police officer C.V. Eckrich will give a "active shooter" presentation. Afterwards he will be taking questions. That is a timely and very important topic. I'm sure the question and answer period will be most educational for gun owners!

Delegate Rob Bell will speak about 10 minutes before the meeting officially starts on his candidacy for Attorney General next year. He said he will stay for the meeting, too.

The Health and Public Policy Committee of the American College of Physicians has recommended that this question be added to the litany of queries doctors ask our patients during routine visits. Do you smoke? Do you practice protected sex? Have you had your flu vaccination? Are any firearms kept in or around your home?

From a public-health standpoint, adding this question to the medical history must seem logical to policy gurus far removed from the trenches of primary care. According to the American Foundation for Suicide Prevention, 60% of the 30,000 Americans who take their own lives every year do so with a firearm. Ninety die every day from shootings—60 are suicide, 30 are murders.

Yet as horrified as I am by these losses, I cannot understand how my asking this question will help. If a patient’s answer is “Yes,” then what I am to say?

Of course, the platitudes: Guns can be a danger around the home, especially one with children. Make sure you use gunlocks or a special safe. Everyone knows this; it’s akin to telling patients that smoking is hazardous to one’s health. And now that my patient has admitted that he owns a firearm, this fact is duly recorded into the—secure, of course!—electronic medical record.

If my patient suffers from mental illness or substance abuse but is not, in my estimation, a danger to himself or others, then what? Report the patient to someone, some agency? Who might that be? Will my patient be harmed more than helped? What will it do to my ongoing relationship with my patient?

. . .

I have had patients who died from firearm suicide, and their deaths will haunt me the rest of my life. I can ask: Are any firearms kept in and around your home?

But then what do I do if they answer: Yes?

As a CCW permit holder, is a car holster legal?

The topic really says it all. I have looked online and i am having a hard time coming to a conclusion here. I have an Alien Gear IWB holster and carry every where I go. With that said, I have a Hx of lower lumbar back pain and when getting in my vehicle, carrying my weapon tends to cause me minor discomfort.

Recently, Alien Gear announced their Cloak DOCK mounting solution (can be used in cars, homes, you name it really). It's a mount that securely holds their OWB holster with paddle attachment for seamless transitioning. Since I own an Alien Gear OWB holster too, I went ahead and bought this mount and installed it in my car. It's been perfect for me as now I unholster my weapon and place it in the mounting solution when driving. And when I get to my destination, I holster back up in my IWB.

Am I breaking any laws with this? Obviously if I were to be pulled over, the first and immediate thing I would do is identify that I am carrying and the location of said weapon. Since implementing it, it's been such a nice break on my back. I've included a picture for reference.

Please correct me if I'm wrong, but we were taught both initially and throughout my military career this this would be verboten.

Specifically, the "experts" say:

What if, commensurate with §'s 331, 332, and 333, it's not an "insurrection" but a restoration much the same as the Battle of Athens, sometimes called the McMinn County War. It was a restoration of Constitutional, state, and local law led by citizens in Athens and Etowah, Tennessee, United States, against the local and corrupt government in August 1946. The citizens, including some World War II veterans, accused the local officials of predatory policing, police brutality, political corruption and voter intimidation.

I know very few individuals who would ever participate in an insurrection against a lawfully-elected government. I know many, however, who would respond appropriately to stop the unlawful actions of a wayward government i.e. one that was no longer acting in the lawful capacity to which they were elected.

After many, many years (35 +) with Sun Trust Bank, I have been told that they do not allow anyone other than LEOs to carry in the offices. Been OCing there all along and had many good conversations with the staff. No more.

Went up the food chain and received the same answer every time. They did not respond to me in writing, but rather through the branch manager verbally who also let me see her computer screen - no guns allowed except for law enforcement officers.

I am in the process of moving my accounts to 1st Union Bank & Trust who does not make that distinction/limitation.

Interestingly enough there was a bump in the road when I was at 1st Union yesterday where I already had 2 small accounts - the teller told me that it was against federal law to carry in a bank - his CHP instructor told him so. [head slap]

He has now been corrected by the corporate office (there is no such law) and the branch manager has welcomed me with open arms [pun intended]

The teller has apologized profusely. "No problem," I said and we had a nice conversation about taking legal advice from instructors and LEOs.

I was recently stopped while open carrying in Hales Corners. As I was walking down the sidewalk I seen a cop waiting for me so I just proceeded on my way because I wasn't doing anything wrong. When I came up to the officer he Grabbed my arm and made me put my hands up while he started to disarm me. I responded that I do not consent to any search or seizures and asked if I was being detained (which he said no I wasn't). he then continued to pat me down after taking my fire-arm.

If I'm not being detained then I should be free to go but how can I do that if they have my fire-arm.

Is this legal for them to do?
