For gun policy watchers in 2014, the game has become a one-sided affair. Gun rights advocates continue to rack up political and legal victories, while the anti-gun movement “seems to have run out of steam entirely” says John Pierce, co-founder of OpenCarry.org, and a Virginia gun rights attorney specializing in ‘gun trusts’ and the restoration of gun rights under Virginia and federal law.



2014 looked promising for gun rights from the ‘get-go’ when in February the Federal Ninth Circuit held that the Second Amendment does not permit states to require citizens to justify their need to carry guns. The Court struck down California’s “may issue” carry permit scheme, generally following the precedent set by the Seventh Circuit when it struck down the Illinois ban on carrying handguns in 2012.



July 1st then brought clarity to open carry in Kansas when a law took effect to clearly preempt localities from banning open carry.



And then on July 29th, Federal District Judge Frederick J. Sculin Jr. struck down the District of Columbia’s ban on carrying handguns in public. For several days thereafter, citizens legally carried handguns about the District without causing alarm or crime. Judge Sculin later stayed his ruling to allow the District time to enact a reasonable scheme of gun carry regulations. The District’s response so far has been to draft a draconian may-issue permitting scheme like the one struck down by the Ninth Circuit early this year, and, adding insult to injury, ban gun carriers access to public transportation, not even allowing gun owners to sit in the back of the bus.

"CYPHER, J. This is an appeal by the Commonwealth after a

single justice of the Supreme Judicial Court allowed the

Commonwealth's petition under Mass.R.Crim.P. 15, as appearing in

422 Mass. 1501 (1996). In ruling on the defendants' motions to

suppress, a judge in the Superior Court held that the seizure by

police officers of a firearm found under a passenger's seat

during a "patfrisk" of the interior of a motor vehicle was

impermissible because, although the stop of the vehicle was

justified, the police had exceeded the permissible scope of the

search when they looked under the passenger's seat before the

occupants returned to the vehicle. Specifically, the judge

reasoned that "[a]ny suspicion which might have been prompted by

any movement (or lack thereof) by the car's occupants was

dispelled by the removal and pat frisk of each individual's

person."

Basically, 4 gang members are in a vehicle making movements, acting funny. Some of the guys are known to the detectives for either carrying firearms or being involved in violence/drugs. Vehicle is stopped for no blinker. Occupants are ordered to exit and pat frisked. Pat frisk of them reveals nothing. Pat frisk of car finds revolver.



Defense says "wait you can't pat frisk the car if you don't find anything on my client". Negative my friend. The point of a pat frisk is to stop them from sitting back in car and shooting you in face or someone else.



Note: above is very SHORT synopsis. Read the case for a really good example of what RAS is and how it works/ is built. The defendant's motions, what he says, how well he's known, his movements before they got in the car, who was with, what the group was doing prior, there being current rival gang tensions, ALL build RAS needed.



This is not an example of OC, but it's certainly an example of how every little detail can be used to build RAS and extremely fast.

While on FaceBook today, I saw the below comment posted to the Frankfort firearm group.





"wanted to share this with my fellow gun lovers.

KNOW YOUR RIGHTS! I had an altercation this past weekend during a festival I was set up at. I wont mention the city due to legal reasons. Anyone who knows me knows I an a STRONG second amendment advocate and know that I ALWAYS carry for my protection. Veterans fought and died for my rights and I refuse to allow a bunch of tree hugging liberals take them away. During my festival (which was held in a public park) a member of the festival city committee went off on me for carrying. Told me to get my stuff and get off the premisis because there is a sign posted in the park "NO FIREARMS". I proceeded to tell her that sign means nothing because its illegally posted. You CAN NOT prohibit guns in a public area (parks, parking lots, sidewalks, ect.) KRS 237.110 sub 16 lists the areas in KY where guns are prohibited. Further on in that law also states " No Firearms signs have no force of law in KY unless posted in an area previously mentioned in sub 16." Therefore that sign is void by contitutional law and no Mayberry city rules can over ride that. I called in some higher powers I know regarding this. Turns out the lady who approached me is with the group MOMS DEMAND ACTION. Now MDA is the group who is hasseling Kroger and many other stores who allow carrying trying to bully them into banning guns. Since her group is supposed to stay peaceful and cant make their group political...she broke 2 laws. She was advocating for her group while representing a city committee for a festival. She also threatened me and became aggressive. She was arrested for her troubles. Keep in mind this ONLY works in public areas. You can not be arrested for going into a store with a sign posted. BUT if they ask you to leave, you must do so or can be arrested for trespassing. Score 1 for the second amendment."


I mentioned this being a 65.870 violation and the OP said 65.870 wouldn't apply because it is a "public" park. After several back and forth questions and answers between us, he states that 1) Taxpayers pay for the park and it is city controlled, but not owned or claimed by the city. 2) No one owns the land that is the park. I reason that 1) Not a lick of that logic makes a lick of damn sense. But I have been surprised before. Can land in KY. be "un-owned" as he claims? If so, who pays taxes on the land or how is the land tax exempt? Why does the city maintain control over the land but they don't "own" it? I'm betting the guy is misinformed, but I wanted to check to make sure that I'm not the misinformed one.

Ok, so let me get this straight.... we just had a school shooting and we had kids hiding in fear and in fear for their lifes with someone that shot at the school and one person injured and all that they we're able to do was hide and hope for law enforcement to show up........This is unacceptable, why wasnt are teachers armed, janitors armed, and ther school employees armed and able to protect our children.



This time it was only shots fired at the school.... but next time the shooter might actually go into the school and start killing students and staff while people hide and call for police



Kentucky has a school program called the "POST Program" which allows school personal to be trained and once trained to carry firearms on them in defense of themselves and of the students, when will JCPS wake up and approve this program and stop putting the students at risk?



Is your Mom, Your Dad, Grand Parent, Sister, Daughter, friends or neighbor who either go to the school as students or go there to work,are their lifes not important enough to be able to protect themselves or should we just pray that the'll make it out alive and unharmed?

As many know here I am not one to recommend a product. But this one surprised me! I have been carrying 24/7 for the last 40 years as of this month. I have used many dozens of holster and belts but none seem to keep a heavy loaded weapon tight against your side. Now these days I carry a Glock 21sf loaded with Hornady Critical Duty rounds and a double mag pouch too boot. As many of you know this gets a bit heavy and causes even the best Bianchi belt to sag miserably. I found and now wear a belt that is really well made and made in the USA! and hold the heavy gun and mags high and tight as I prefer it. In 40 years this is the first time I found a high quality belt far cheaper than Bianchi. Here is the links to the Holster store.. note the price $39.95 and it's worth twice the price in my opinion when you consider what Bianchi and other brands cost. I hope this helps anyone who has the same issues with carry of heavy weapons.

Election season is coming up! I would like to OC at my polling place in support of 2A. Has anyone ever done this? To complicate matters, my polling place is a middle school. Are there any statutes or court cases that would keep this from being possible?

Judge Cohn ruled from the bench yesterday that the freedom of information commission cannot find abuse simply because one files a multitude of appeals to the commission.



Many folks file many requests, get no response or responses that do not comply with our FOIA Act, and then file appeals in each case..leading to an active citizen having many complaints before the freedom of information commission (that everyone should try to get abolished !)



Under 1-206(b)(2) the commission can decide not to hear a case for 3 reasons: 1) injustice 2) abuse of admin process 3) jurisdictional issues



It was under abuse that the commission claimed that they could not hear my various cases simply because the commission is overburdened and I filed many complaints with them. The judge would have none of that and ruled in 2 seconds that filing many cases is not abuse.



I expect a written decision in about 1-3 months time. I'll post it if possible.



Many folks have filed multiple cases (some almost equal to mine - like Ed P....that the commission has said disparaging things about recently in their regular meetings).... so I'll pass this information along if anyone gets one of their goofy notices not to schedule a case.

Cops Seize Car When Told To Get A Warrant, Tell Owner That's What He Gets For 'Exercising His Rights'

Yeah, so you've read the headline. No criminal activity. No charges brought. And a cheap shot fired across the bow of the Fourth Amendment, not to mention Vermont's own Constitution.



But let's travel back further to set this up. Twenty-one-year-old Gregory Zullo was supposedly pulled over for having his license plate registration sticker (incidentally) covered by a small amount of snow.



Not a crime. From the ACLU filing [pdf link]:

At all times relevant to this action, it was not a violation of Vermont law to drive a car on which the validation sticker on the rear license plate – but not the numbers and letters of the license plate itself – was touched by snow, leaves, or any other material.

The lawsuit notes that the officer who stated this was the reason he initiated the event spent no further time on that subject. He didn't bother to brush the snow away from the registration sticker or have Zullo do it, despite the fact that both spent over 30 minutes no more than a few inches away from the offending plate.



Officer Hatch spent most of his time trying to talk Zullo into allowing him to search the vehicle without a warrant. Hatch seemed to be convinced that Zullo was involved with the heroin traffickers he was searching for. Hatch tried everything, including lying.

More than once, the defendant’s employee told Mr. Zullo that Mr. Zullo should consent to a search because the police dog in the back of his truck smelled something.



But the police dog in Hatch’s truck was not a drug detection dog, and, at all times during the encounter between Hatch and Mr. Zullo, the dog remained in the truck with the truck’s windows rolled up.

This isn't just a mere allegation based on Zullo's statements to the ACLU. It's confirmed during the few minutes of actual dialog captured by the dash cam's mic. (Interestingly [or not, depending on your particular faith in law enforcement], Officer Hatch was wired for sound, but either his body mic wasn't activated or was buried so far beneath his winter gear it was rendered useless.) At no point does the non-drug dog appear outside the vehicle. About 30 minutes into the recording, Hatch returns to his vehicle to inform his precinct that Zullo wouldn't agree to warrantless search, so "he's [Hatch] just going to take it [Zullo's car]."

During that same call, the defendant’s employee admitted that he did not have a drug detection dog with him, but would have access to one at the state police barracks. App. A at 33:59

As the officers and Zullo waited for the tow truck, they continued to try to get his permission for a search. Zullo held firm, so the cops ditched him miles from home in 20-degree weather.

Mr. Zullo asked Hatch if he could retrieve his money and cell phone from his car, because he did not know how he would get home without either item.



Hatch refused, saying that getting home was “not my problem,” and warned Mr. Zullo that if he attempted to retrieve those items from the car he would be arrested. When Mr. Zullo walked towards his car, Hatch placed his hands on Mr. Zullo to restrain him from reaching the car.



After the tow truck arrived and took Mr. Zullo’s car, Hatch and the second state trooper left the scene, leaving Mr. Zullo stranded on the side of Route 7.

After being seized, Zullo's car was searched by Officer Hatch using an actual drug dog and an actual warrant [pdf link]. Nothing illegal was uncovered. Hatch found both a pipe and a grinder with "marijuana residue." Again, no laws were broken by Zullo's possession of these items.

On June 6, 2013, Governor Shumlin signed the bill, and the relevant parts of the enactment became effective on July 1, 2013. 2013 Vt. Acts & Resolves 669. As a result, at the time of the events giving rise to this suit, Vermont law deemed possession of an ounce or less of marijuana by a person over the age of twenty-one a civil offense, punishable by no more than a fine contestable in the Judicial Bureau. Vt. Stat. Ann. tit. 18, §4230a(b)(1).

That part of the state statutes reads:

Except as otherwise provided in this section, a person 21 years of age or older who possesses one ounce or less of marijuana or five grams or less of hashish or who possesses paraphernalia for marijuana use shall not be penalized or sanctioned in any manner by the State or any of its political subdivisions or denied any right or privilege under State law.

Both the drug angle and the registration sticker angle dead end into a search and seizure based on non-criminal actions. The state does have an out (one that will likely be deployed in its defense against Zully's lawsuit) that still allows law enforcement to search for marijuana, even if what's discovered isn't a criminal amount.

This section is not intended to affect the search and seizure laws afforded to duly authorized law enforcement officers under the laws of this State. Marijuana is contraband pursuant to section 4242 of this title and subject to seizure and forfeiture unless possessed in compliance with chapter 86 of this title (therapeutic use of Cannabis).

But this should have resulted in something better than the response given to Zully when he finally made his way to the precinct to retrieve his vehicle (as well as being told he was responsible for the towing fees).

When Mr. Zullo asked the defendant’s employee why he had to pay for the tow, the defendant’s employee told him that the tow cost was Mr. Zullo’s fault for exercising his rights.

There's the now-familiar lesson: exercise your rights and cops will make you pay -- one way or another -- for making their jobs difficult. This was plainly stated by an LAPD member shortly after the situation in Ferguson blew up: be anything but compliant and you'll be hurting. If you have problems with us steamrolling your rights, sue us. That attitude brings us to this. Another lawsuit filed against a law enforcement agency simply because a police officer couldn't handle being told, "No."

The District of Columbia is too clever by half. When a federal judge ordered the city to recognize the right of residents and nonresidents to carry guns for self-defense, the city channeled Rube Goldberg, the cartoonist who drew those convoluted designs to make the easy look difficult. The new ordinance makes it a crime to be within 1,000 feet of “a dignitary or high-ranking official of the United States or a state, local, or foreign government.” The alderpersons obviously think there are enough “dignitaries” on the street to render the judge’s ruling unenforceable.

Wait, liberal journalists and morons is an oxymoron. Anyways, the below linked story was written by a firearms patent attorney who in his words represents more firearms companies than anyone else in the world.



I think he does a very good job of describing "proper" firearms terminology to use if you are going to attempt to write an article about firearms and want to sound somewhat intelligent. Maybe more intelligent people than I can find holes in his article about terminology but it sounded good to me. I think this article could also be used to "educate" those in our circle of friends/associates who are confused/uneducated about guns.

The CCTVangelist - Our city’s crime-camera clusterfuck has, like so many other failures, provided an opening for the ambitious private sector to prove it can do the crucial oppressive work of government at considerable cost savings. A few years back, it suddenly seemed every crime story on NOLA.com prompted a comment from one Bryan Lagarde of Project NOLA, shilling his crime cameras. He was all over the Marigny forum, where he found an eager, receptive audience for his sales pitch. He was a man on a mission.

The decision to carry a gun wasn’t one I had fully thought through the implications of; it had been a reaction to fear which I rationalized and then habitualized. Without delving any further into the thorny politics of firearms, I now see the pistol I used to pack for what it was: a security blanket, a magic talisman I superstitiously hoped would insulate me from the brutal economic inequalities of the place I chose to live.

When I quit carrying a handgun around, I found I stopped looking at casual interactions as potential shootouts. If you have a camera, you might feel better without it.

Hi,



I live in Mississippi and frequently go into Memphis, TN. I know that in TN you have to have a permit to open carry or conceal carry. In MS you have to have a permit to conceal but not open (if I read that law correctly). But I can't find anything about conceal carry or open carry across the MS line into TN. I keep a .380 in my truck but with all the attacks in Memphis lately but mobs, I'm really not comfortable not having it on me. Can anyone tell me what the law is on carrying across the MS/TN stateline is for open and conceal carry. I would prefer open. But conceal works. It's just not as much of a deterrent.

A Georgia Carry member, wishing to attend the "Wings Over Georgia" airshow being held at the Richard B. Russell Regional Airport, a publicly owned property, looked at the rules and regulations for said airshow and found something disturbing:

"All forms of weapons are prohibited. All persons, vehicles and hand carried items are subject to search at anytime while on the airport facility. Narcotics and paraphernalia are strictly prohibited. There is a no-tolerance standard for fighting or protesting at anytime. No political activity is authorized unless pre-approved by air show management. Failure to follow the rules will result in prosecution and removal from the airport facility."



Knowing full well that the Georgia Legislature had reserved unto itself all matters of regulating firearms (with the exception of discharge), he contacted the Floyd County Sheriff's Office and made inquiry on the 11th of September, asking what their authority to ban weapons was.



After some back and forth with the Sheriff's Office the member was forced to file suit which may be read below:

Shoulder holsters?

Just was wondering if anyone here uses them and what brands they prefer. I used shoulder holsters in the militar and thought they were pretty comfortable and was planning on getting a set for concealed carry.

I have been scratchin' my head on the legal ramifications for collectors that hold a valid 03 C&R FFL.



I-594 does not include a provision for collectors or CPL holders.

AS per 18USC collectors are distinctly differnent than dealers, and as such under 594 would be required to get a background check.



If I wanted to buy this C&R firearm today I would not need said check, as long as I have a valid 03 C&R FFL.

If 594 comes to fruition would I be in violation with this same transaction? I have not been able to find a way to complete this transaction in keeping with the letter of the proposed law.





How could a C&R holder comply with 594 if it comes to fruition?

Would this be a good enough test case to repeal the proposed law?

THE PRESIDENT: Hello, CBC! (Applause.) Thank you so much. Thank you. Please, everybody have a seat. It is wonderful to be with all of you tonight. It's good to be with the conscience of the Congress. (Applause.) Thank you, Chairman Cleaver and brother Payne, for all that you do each and every day. Thank you, Dr. Elsie Scott, president and CEO of the CBC Foundation, and all of you for your outstanding work with your internship program, which has done so much for so many young people. And I had a chance to meet some of the young people backstage -- an incredible, unbelievably impressive group.



You know, being here with all of you -- with all the outstanding members of the Congressional Black Caucus -- reminds me of a story that one of our friends, a giant of the civil rights movement, Reverend Dr. Joseph Lowery, told one day. Dr. Lowery -- I don't think he minds me telling that he turns 90 in a couple weeks. (Applause.) He’s been causing a ruckus for about 89 of those years. (Laughter.)



A few years back, Dr. Lowery and I were together at Brown Chapel A.M.E. Church in Selma. (Applause.) We've got some Selma folks in the house. (Applause.) And Dr. Lowery stood up in the pulpit and told the congregation the story of Shadrach and Meshach and Abednego in the fiery furnace. You know the story -- it’s about three young men bold enough to stand up for God, even if it meant being thrown in a furnace. And they survived because of their faith, and because God showed up in that furnace with them.



Now, Dr. Lowery said that those three young men were a little bit crazy. But there’s a difference, he said, between good crazy and bad crazy. (Applause.) Those boys, he said, were “good crazy.” At the time, I was running for president -- it was early in the campaign. Nobody gave me much of a chance. He turned to me from the pulpit, and indicated that someone like me running for president -- well, that was crazy. (Laughter.) But he supposed it was good crazy.



He was talking about faith, the belief in things not seen, the belief that if you persevere a better day lies ahead. And I suppose the reason I enjoy coming to the CBC -- what this weekend is all about is, you and me, we're all a little bit crazy, but hopefully a good kind of crazy. (Applause.) We’re a good kind of crazy because no matter how hard things get, we keep the faith; we keep fighting; we keep moving forward.



And we've needed faith over these last couple years. Times have been hard. It’s been three years since we faced down a crisis that began on Wall Street and then spread to Main Street, and hammered working families, and hammered an already hard-hit black community. The unemployment rate for black folks went up to nearly 17 percent -- the highest it’s been in almost three decades; 40 percent, almost, of African American children living in poverty; fewer than half convinced that they can achieve Dr. King’s dream. You’ve got to be a little crazy to have faith during such hard times.



It’s heartbreaking, and it’s frustrating. And I ran for President, and the members of the CBC ran for Congress, to help more Americans reach that dream. (Applause.) We ran to give every child a chance, whether he’s born in Chicago, or she comes from a rural town in the Delta. This crisis has made that job of giving everybody opportunity a little bit harder.



We knew at the outset of my presidency that the economic calamity we faced wasn’t caused overnight and wasn’t going to be solved overnight. We knew that long before the recession hit, the middle class in this country had been falling behind -– wages and incomes had been stagnant; a sense of financial security had been slipping away. And since these problems were not caused overnight, we knew we were going to have to climb a steep hill.



But we got to work. With your help, we started fighting our way back from the brink. And at every step of the way, we’ve faced fierce opposition based on an old idea -- the idea that the only way to restore prosperity can’t just be to let every corporation write its own rules, or give out tax breaks to the wealthiest and the most fortunate, and to tell everybody that they're on their own. There has to be a different concept of what America’s all about. It has to be based on the idea that I am my brother’s keeper and I am my sister’s keeper, and we’re in this together. We are in this thing together. (Applause.)



We had a different vision and so we did what was right, and we fought to extend unemployment insurance, and we fought to expand the Earned Income Tax Credit, and we fought to expand the Child Tax Credit -- which benefited nearly half of all African American children in this country. (Applause.) And millions of Americans are better off because of that fight. (Applause.)



Ask the family struggling to make ends meet if that extra few hundred dollars in their mother’s paycheck from the payroll tax cut we passed made a difference. They’ll tell you. Ask them how much that Earned Income Tax Credit or that Child Tax Credit makes a difference in paying the bills at the end of the month.



When an army of lobbyists and special interests spent millions to crush Wall Street reform, we stood up for what was right. We said the time has come to protect homeowners from predatory mortgage lenders. The time has come to protect consumers from credit card companies that jacked up rates without warning. (Applause.) We signed the strongest consumer financial protection in history. That’s what we did together. (Applause.)



Remember how many years we tried to stop big banks from collecting taxpayer subsidies for student loans while the cost of college kept slipping out of reach? Together, we put a stop to that once and for all. We used those savings to make college more affordable. We invested in early childhood education and community college and HBCUs. Ask the engineering student at an HBCU who thought he might have to leave school if that extra Pell Grant assistance mattered. (Applause.)



We’re attacking the cycle of poverty that steals the future from too many children -- not just by pouring money into a broken system, but by building on what works -– with Promise Neighborhoods modeled after the good work up in Harlem; Choice Neighborhoods rebuilding crumbling public housing into communities of hope and opportunity; Strong Cities, Strong Communities, our partnership with local leaders in hard-hit cities like Cleveland and Detroit. And we overcame years of inaction to win justice for black farmers because of the leadership of the CBC and because we had an administration that was committed to doing the right thing. (Applause.)



And against all sorts of setbacks, when the opposition fought us with everything they had, we finally made clear that in the United States of America nobody should go broke because they get sick. We are better than that. (Applause.) And today, insurance companies can no longer drop or deny your coverage for no good reason. In just a year and a half, about one million more young adults have health insurance because of this law. (Applause.) One million young people. That is an incredible achievement, and we did it with your help, with the CBC’s help. (Applause.)



So in these hard years, we’ve won a lot of fights that needed fighting and we’ve done a lot of good. But we’ve got more work to do. So many people are still hurting. So many people are still barely hanging on. And too many people in this city are still fighting us every step of the way.



So I need your help. We have to do more to put people to work right now. We’ve got to make that everyone in this country gets a fair shake, and a fair shot, and a chance to get ahead. (Applause.) And I know we won’t get where we need to go if we don’t travel down this road together. I need you with me. (Applause.)



That starts with getting this Congress to pass the American Jobs Act. (Applause.) You heard me talk about this plan when I visited Congress a few weeks ago and sent the bill to Congress a few days later. Now I want that bill back -- passed. I’ve got the pens all ready. I am ready to sign it. And I need your help to make it happen. (Applause.)



Right now we’ve got millions of construction workers out of a job. So this bill says, let’s put those men and women back to work in their own communities rebuilding our roads and our bridges. Let’s give these folks a job rebuilding our schools. Let’s put these folks to work rehabilitating foreclosed homes in the hardest-hit neighborhoods of Detroit and Atlanta and Washington. This is a no-brainer. (Applause.)



Why should we let China build the newest airports, the fastest railroads? Tell me why our children should be allowed to study in a school that’s falling apart? I don’t want that for my kids or your kids. I don’t want that for any kid. You tell me how it makes sense when we know that education is the most important thing for success in the 21st century. (Applause.) Let’s put our people back to work doing the work America needs done. Let’s pass this jobs bill. (Applause.)



We’ve got millions of unemployed Americans and young people looking for work but running out of options. So this jobs bill says, let’s give them a pathway, a new pathway back to work. Let’s extend unemployment insurance so that more than six million Americans don’t lose that lifeline. But let’s also encourage reforms that help the long-term unemployed keep their skills sharp and get a foot in the door. Let’s give summer jobs for low-income youth that don’t just give them their first paycheck but arm them with the skills they need for life. (Applause.)



Tell me why we don’t want the unemployed back in the workforce as soon as possible. Let’s pass this jobs bill, put these folks back to work. (Applause.)



Why are we shortchanging our children when we could be putting teachers back in the classroom right now, where they belong? (Applause.) Laying off teachers, laying off police officer, laying off firefighters all across the country because state and local budgets are tough. Why aren’t we helping? We did in the first two years. And then this other crowd came into Congress and now suddenly they want to stop. Tell me why we shouldn’t give companies tax credits for hiring the men and women who’ve risked their lives for this country -- our veterans. There is no good answer for that. They shouldn’t be fighting to find a job when they come home. (Applause.)



These Republicans in Congress like to talk about job creators. How about doing something real for job creators? Pass this jobs bill, and every small business owner in America, including 100,000 black-owned businesses, will get a tax cut. (Applause.) You say you’re the party of tax cuts. Pass this jobs bill, and every worker in America, including nearly 20 million African American workers, will get a tax cut. (Applause.) Pass this jobs bill, and prove you’ll fight just as hard for a tax cut for ordinary folks as you do for all your contributors. (Applause.)



These are questions that opponents of this jobs plan will have to answer. Because the kinds of ideas in this plan in the past have been supported by both parties. Suddenly Obama is proposing it -- what happened? (Laughter.) What happened? You all used to like to build roads. (Laughter.) Right? What happened? Reverend, you know what happened? I don’t know. They used to love to build some roads. (Laughter.)



Now, I know some of our friends across the aisle won’t support any new spending that’s not paid for. I agree that’s important. So last week, I laid out a plan to pay for the American Jobs Act, and to bring out -- down our debt over time. You say the deficit is important? Here we go. I’m ready to go. It’s a plan that says if we want to create jobs and close this deficit, then we’ve got to ask the folks who have benefited most -- the wealthiest Americans, the biggest, most profitable corporations -- to pay their fair share. (Applause.)



We are not asking them to do anything extraordinary. The reform we’re proposing is based on a simple principle: Middle-class folks should not pay higher tax rates than millionaires and billionaires. (Applause.) That’s not crazy -- or it’s good crazy. (Laughter.) Warren Buffett’s secretary shouldn’t pay a higher tax rate than Warren Buffett. A teacher or a nurse or a construction worker making $50,000 a year shouldn’t pay higher tax rates than somebody making $50 million. That’s just common sense.



We’re not doing this to punish success. This is the land of opportunity. I want you to go out, start a business, get rich, build something. Out country is based on the belief that anybody can make it if they put in enough sweat and enough effort. That is wonderful. God bless you. But part of the American idea is also that once we've done well we should pay our fair share -- (applause) -- to make sure that those schools that we were learning in can teach the next generation; that those roads that we benefited from -- that they're not crumbling for the next bunch of folks who are coming behind us; to keep up the nation that made our success possible.



And most wealthy Americans would agree with that. But you know the Republicans are already dusting off their old talking points. That's class warfare, they say. In fact, in the next breath, they’ll complain that people living in poverty -- people who suffered the most over the past decade -- don’t pay enough in taxes. That's bad crazy. (Laughter and applause.) When you start saying, at a time when the top one-tenth of 1 percent has seen their incomes go up four or five times over the last 20 years, and folks at the bottom have seen their incomes decline -- and your response is that you want poor folks to pay more? Give me a break. If asking a billionaire to pay the same tax rate as a janitor makes me a warrior for the working class, I wear that with a badge of honor. I have no problem with that. (Applause.) It's about time.



They say it kills jobs -- oh, that's going to kill jobs. We’re not proposing anything other than returning to the tax rates for the wealthiest Americans that existed under Bill Clinton. I played golf with Bill Clinton today. I was asking him, how did that go? (Laughter.) Well, it turns out we had a lot of jobs. The well-to-do, they did even better. So did the middle class. We lifted millions out of poverty. And then we cut taxes for folks like me, and we went through a decade of zero job growth.



So this isn't speculation. We've tested this out. We tried their theory; didn’t work. Tried our theory; it worked. We shouldn’t be confused about this. (Applause.)



This debate is about priorities. If we want to create new jobs and close the deficit and invest in our future, the money has got to come from somewhere. And so, should we keep tax loopholes for big oil companies? Or should we put construction workers and teachers back on the job? (Applause.) Should we keep tax breaks for millionaires and billionaires? Or should we invest in our children’s education and college aid? Should we ask seniors to be paying thousands of dollars more for Medicare, as the House Republicans propose, or take young folks’ health care away? Or should we ask that everybody pay their fair share? This is about fairness. And this is about who we are as a country. This is about our commitment to future generations.



When Michelle and I think about where we came from -- a little girl on the South Side of Chicago, son of a single mom in Hawaii -- mother had to go to school on scholarships, sometimes got food stamps. Michelle's parents never owned their own home until she had already graduated -- living upstairs above the aunt who actually owned the house. We are here today only because our parents and our grandparents, they broke their backs to support us. (Applause.) But they also understood that they would get a little bit of help from their country. Because they met their responsibilities, this country would also be responsible, would also provide good public schools, would also provide recreation -- parks that were safe, making sure that they could take the bus without getting beat over the head, making sure that their kids would be able to go to college even if they weren’t rich.



We're only here because past generations struggled and sacrificed for this incredible, exceptional idea that it does not matter where you come from, it does not matter where you’re born, doesn’t matter what you look like -- if you’re willing to put in an effort, you should get a shot. You should get a shot at the American Dream. (Applause.)



And each night, when we tuck in our girls at the White House, I think about keeping that dream alive for them and for all of our children. And that’s now up to us. And that’s hard. This is harder than it’s been in a long, long time. We’re going through something we haven’t seen in our lifetimes.



And I know at times that gets folks discouraged. I know. I listen to some of you all. (Laughter.) I understand that. And nobody feels that burden more than I do. Because I know how much we have invested in making sure that we’re able to move this country forward. But you know, more than a lot of other folks in this country, we know about hard. The people in this room know about hard. (Applause.) And we don’t give in to discouragement.



Throughout our history, change has often come slowly. Progress often takes time. We take a step forward, sometimes we take two steps back. Sometimes we get two steps forward and one step back. But it’s never a straight line. It’s never easy. And I never promised easy. Easy has never been promised to us. But we’ve had faith. We have had faith. We’ve had that good kind of crazy that says, you can’t stop marching. (Applause.)



Even when folks are hitting you over the head, you can’t stop marching. Even when they’re turning the hoses on you, you can’t stop. (Applause.) Even when somebody fires you for speaking out, you can’t stop. (Applause.) Even when it looks like there’s no way, you find a way -- you can’t stop. (Applause.) Through the mud and the muck and the driving rain, we don’t stop. Because we know the rightness of our cause -- widening the circle of opportunity, standing up for everybody’s opportunities, increasing each other’s prosperity. We know our cause is just. It’s a righteous cause.



So in the face of troopers and teargas, folks stood unafraid. Led somebody like John Lewis to wake up after getting beaten within an inch of his life on Sunday -- he wakes up on Monday: We’re going to go march. (Applause.)



Dr. King once said: “Before we reach the majestic shores of the Promised Land, there is a frustrating and bewildering wilderness ahead. We must still face prodigious hilltops of opposition and gigantic mountains of resistance. But with patient and firm determination we will press on.” (Applause.)



So I don’t know about you, CBC, but the future rewards those who press on. (Applause.) With patient and firm determination, I am going to press on for jobs. (Applause.) I'm going to press on for equality. (Applause.) I'm going to press on for the sake of our children. (Applause.) I'm going to press on for the sake of all those families who are struggling right now. I don’t have time to feel sorry for myself. I don’t have time to complain. I am going to press on. (Applause.)



I expect all of you to march with me and press on. (Applause.) Take off your bedroom slippers, put on your marching shoes. Shake it off. (Applause.) Stop complaining, stop grumbling, stop crying. We are going to press on. We’ve got work to do, CBC. (Applause.)

I'm sure most are familiar that this place was robbed earlier this week. The suspect has died after taking 1 bullet through a lung and the other into his face/head. After he was shot by the truck stops owner, he fled on foot for several hundred feet before collapsing onto the ground. I believe he was shot with a .40 cal but I can not confirm this. The fact that he suffered mortal wounds and was still able to flee (and could have fired back) several hundred feet, and lived a week later is something note worthy.

Summary:



Contrary to popular assumptions, a felony conviction is not required to lose your gun rights under federal law. So the term "felon in possession" is commonly used to refer to persons who have in actuality only been convicted only of misdemeanors, and often non-violent misdemeanors at that. One of these folks just one a court case challenging this law.



The Gun Control Act of 1968 as amended strips gun rights from anyone convicted of a “crime punishable by imprisonment for a term exceeding one year” [but this does not] does not include—



(A) any Federal or State offenses pertaining to antitrust violations, unfair trade practices, restraints of trade, or other similar offenses relating to the regulation of business practices, or



(B) any State offense classified by the laws of the State as a misdemeanor and punishable by a term of imprisonment of two years or less.



In Binderup v. Holder, the federal district court held that a Pennsylvania state misdemeanor conviction for "corruption of minor" where defendant could have been sentenced to more than 2 years was held NOT to be sufficient to strip defendant of right to bear arms.



This holding is a really big deal.



If appealed, 3d Cir. is likely to affirm the District Ct.

If I have a CCW license can I transport the weapon on my person in a vehicle?

Yes. Current law generally requires that firearms other than handguns being transported in or on a vehicle, or placed inside a vehicle be unloaded, and not hidden or concealed when within reach of any occupants of the vehicle. In regard to other weapons not authorized under a CCW license, they could not be carried concealed and within reach.

Under the new CCW law, a person with a CCW license may carry a concealed weapon (handgun, knife, electric weapon or billy club) in a vehicle.

However, long guns are still subject to the requirement of being unloaded and not hidden when within reach.



If I do not have a CCW license how do I transport weapons in a vehicle?

A. Handguns

The law now allows a person who can legally possess a handgun to do the following without a CCW permit:

• place, possess, or transport a handgun in a vehicle without being unloaded or encased.Wis. Stats. § 167.31(2)(b).

• load a handgun in a vehicle. Wis. Stats. § 167.31(2)(c).

• operate an all-terrain vehicle (ATV) with a loaded uncased handgun in the operator‘s possession. Wis. Stat. § 23.33(3)(a).

• place, possess, or transport a handgun in or on a motorboat with the motor running without being unloaded or encased. Wis. Stats. § 167.31(2)(a), (b), (c).

• place, possess, or transport a loaded uncased handgun in or on a

noncommercial aircraft.

IMPORTANT NOTE: Persons who do not have a CCW license may still not carry weapons concealed. In a vehicle this means that the firearm cannot be hidden or concealed and within reach.

Here is a little story of my Wednesday Home Depot shopping.



Went to Home Depot, where I go at least once a week. As I'm entering there stand 2 greeters. I know most of them and usually chat for a moment. This time there was a short older guy with a beard. Never seen him before.



He looks at me and says cover that up! I asked what, this? (my 1911) Why? He said because the sign says so. I hadn't seen a sign there and always open carried in there so I turned around and went out and looked. I walked back in and said 'well it says I can't bring my dog in here and that's all I see". So he goes out and looks and says they must have taken the sign down. I very sarcastically said 'yea, I guess they did!' But, he says, cover it up anyway.



I have reached my limit on BS so I asked him if he was making store policy. He was quick to say no, but added that some people got nervous when they saw guns. I then explained that we live in AZ and if folks got nervous when they see guns they needed to get back to CA ASAP. Enough already!

Reminded me of that old song, Stuck in the middle. "There's clowns to the left of me, Jokers to the right"

Permit Application Questions...

I personally already have my permit and have had it for a few years now, however my fiancee is looking to get hers through West Hartford, and I had a few questions on what's allowed under the new laws...



I went on the West Hartford PD's website and found their instructions and application, it appears the application itself is the standard state with no supplemental form (that's good at least, right?) but...their instructions have me a bit curious. The state form DPS-799-C was revised 05/22/13, and I can't find a copy on the SLFU site, so not sure if it's the most recent or not. The Towns instructions state they were revised February of 2014...so, definitely recent.



The town states to get the application and your certificate and drop them off with cash or check (No mention of money order or bank check, thought that was odd) in the amount of $81.50. They state this is $16.50 for the FBI check, $50.00 for the state check, and $15.00 for a WHPD service fee...which wouldn't bother me much except they then want the $70.00 the application states when you pick up the temporary permit.



This is in addition to them wanting you to schedule an interview with an assistant chief of police and get fingerprinted at this point...has me a bit...concerned. Is that extra $15.00 allowed under the law now? Or just a way to sneak through something extra?



Anyone have recent experience dealing with WHPD and permitting?



Should I just have her do the state required form, fingerprint cards from the State Police and send it in certified mail? (Assuming she's willing to risk the additional hassle)

The threat involved statements about supporters of Islam randomly beheading people throughout Australia until their demands are taken seriously.

In response, local Muslims gathered at a news conference to shout, "Praise Allah!" They weren't shouting it because this murderous thug was stopped. They were shouting it because he succeeded in beheading a woman he'd encountered at random, as if beheading people is somehow something to be worthy of praise. - Source



Personally, I feel their demands should definitely be taken seriously. Seriously, all laws disarming Australians should be struck down. People should seriously re-arm themselves. And if the beheadings commence, the people of Australia should put an immediate and final stop to it whenever and wherever it occurs, as it occurs, hopefully stopping the crime in sufficient numbers to keep it from occurring in the first place.

Just thought I would share what a store owner told me today.



I went to my local liquor store today and while I was walking to the counter I noticed the clerk had a sidearm on her hip.

I said nice accessory

she said thanks

I said thats nice to see becuase I carry also and turned to show her mine.

She immediately said your not supposed to have that in here.

I said oh I'm sorry I didn't see your sign.

She said no sign it's illegal to carry in a liquor store

I couldn't help but chuckle a little while responding no it's not

She said the police station and an officer told me that I was the only one allowed because Im the owner.

I told her they told her wrong that only in a place of business where alcohol is consumed and is their primary source of revenue and though it is their primary source of revenue it is illegal to consume alcohol in a liquor store therefore not included in the statute that its intent and means its for bars.

She said well the police told me that.

I told her I want to encourage you to do more research and pointed her to the osbi website that they have the law book available for you to download and research and to this forum also. That I respected her place of business and I wouldnt carry in her store if she didnt want me too.

She said she didnt care.

Then we had a little more friendly conversation and I left.



Either she was lying or was misinformed or there are still uninformed or misleading officers, I'm beting its one of the later.



TITLE 21 § 1272.1 CARRYING FIREARMS WHERE LIQUOR IS CONSUMED



A. It shall be unlawful for any person to carry or possess any weapon designated in Section 1272 of this title in any establishment where low-point beer, as defined by Section 163.2 of Title 37 of the Oklahoma Statutes, or alcoholic beverages, as defined by Section 506 of Title 37 of the Oklahoma Statutes, are consumed. This provision shall not apply to a peace officer, as defined in Section 99 of this title, or to private investigators with a firearms authorization when acting in the scope and course of employment, and shall not apply to an owner or proprietor of the establishment having a pistol, rifle, or shotgun on the premises. Provided however, a person possessing a valid handgun license pursuant to the provisions of the Oklahoma Self-Defense Act may carry the concealed or unconcealed handgun into any restaurant or other establishment licensed to dispense low-point beer or alcoholic beverages where the sale of low-point beer or alcoholic beverages does not constitute the primary purpose of the business.

Provided further, nothing in this section shall be interpreted to authorize any peace officer in actual physical possession of a weapon to consume low-point beer or alcoholic beverages, except in the authorized line of duty as an undercover officer.

Nothing in this section shall be interpreted to authorize any private investigator with a firearms authorization in actual physical possession of a weapon to consume low-point beer or alcoholic beverages in any establishment where low-point beer or alcoholic beverages are consumed.

LOS ANGELES (AP) — A woman punched repeatedly by a California Highway Patrol officer on the side of a freeway in an incident caught on video will receive $1.5 million under a settlement, and the officer has agreed to resign.











CHP Commissioner Joe Farrow confirmed the settlement in an emailed statement and an attorney for Marlene Pinnock confirmed the dollar amount for The Associated Press.



The punching occurred after motorists' 911 calls reported that Pinnock, who is bipolar, was walking along the freeway and the responding officer pulled her from traffic, according to a legal document in the case.



Wednesday's settlement agreement came after a nine-hour mediation session in Los Angeles.



"When this incident occurred, I promised that I would look into it and vowed a swift resolution," Farrow's statement said. "Today, we have worked constructively to reach a settlement agreement that is satisfactory to all parties involved."



The statement said that Officer Daniel Andrew, who joined the CHP in 2012 and has been on paid administrative leave since the incident, "has elected to resign."



Andrew could still be charged criminally in the case. The CHP forwarded the results of its investigation of the incident to Los Angeles County prosecutors last month, saying he could face serious charges but none have been filed yet.

The bulk of the settlement will take the form of a special needs trust for Pinnock, the CHP said.



Pinnock's attorney Caree Harper said the settlement fulfilled the two elements her side was looking for.



"One of the things we wanted to make sure of was that she was provided for in a manner that accommodated her unique situation in life," Harper said, "and that the officer was not going to be an officer anymore and we secured those things."



Harper said Pinnock will be interviewed by the district attorney's office within a few weeks.



The July 1 video of Andrew punching Pinnock was recorded by a passing driver on Interstate 10 west of downtown Los Angeles.



According to a search warrant made public in court documents last month, Andrew had just pulled Pinnock from oncoming traffic and she resisted by pushing him after multiple drivers called 911 to report her walking barefoot along the side of the freeway.



Andrew then straddled her on the ground as Pinnock resisted by "kicking her legs, grabbing the officer's uniform and twisting her body," the warrant said. Andrew "struck her in the upper torso and head several times with a closed right fist," the records say.



The warrant said Pinnock suffered no signs of physical injury and refused medical treatment. She was placed on a psychiatric hold for two weeks.



Pinnock has been diagnosed with bipolar disorder and had been off her medication for two to three months before the altercation.



In an interview with the AP last month, Pinnock said she believed the officer was trying to kill her.



"He grabbed me, he threw me down, he started beating me," she said. "I felt like he was trying to kill me, beat me to death
